    Thumbs down company sick pay stopped whilst of sick!!!

    Hi could anyone help me,

    I am currently off sickicon with stress , received a letter today from my manager stating that they are not paying me company sick pay from the 12th june(date i went off sick) because i am not phoning in everydayand they think i am looking for other employment. a manager will be coming to see me at at my home on friday for a welfare visit. any advice will be great.

    Really, this is a grey area as some companies will demand that you call them every 10 mins to let them know how you are, however in practice this cannot always be done.

    If you are off sickicon with stress, then I would say that it is important that they do not do anything to harass you or to cause you even further stress. By coming to see you for a welfare visit, they are obviously concerned (whether in a good or bad way) but they are entitled to stop your sick pay if the reasons are thrown into doubt. What those reasons are may become clear after a home visit.

    However, in order to avoid any doubt, I would go to your GP and ask to be signed off, which will not only document why you are off, but should therefore take away any doubt you are "faking it" as a medical professional has advised you not to work (in the words of the certificate).

    I don't know your circumstances, but maybe there are high incidences of absence at your place of work, and you are suffering because of it!

    i have been signed off by the doctor since 12th june, have been sending sick certs into my employer on time.

    therefore, their actions could be considered harassing and they should have no reason to doubt you, given that their actions are exacerbating the situation itself.

    Prior to the meeting, I would give ACAS a call - find them at Acas - How can we help? - and get some advice from them on how to deal with your employers actions.

    You are only entitled to statutory sick pay unless your terms of employment state that they will pay you sick pay as well. If that is the case then it would also say how much and for how long.

    If there is nothing in your terms of employment then you can take it that company sick pay is not available and your are only entitled to £75.40 (pro rata).

    Employment law states that you cannot be asked to phone in more than once per week.

    yes i know that, what i am saying is that they were paying me company sick pay,as i have been with the company for 2 yrs, they have only stopped it as they think i am lying about my illness and looking for other employment,which is not the case.
