    Default egg x 2

    quick question - last year i claimed overlimit charges against Eggicon and they paid in full on recipt of lbaicon

    im sure they asked for signed aceptance including not to pursue claim of any further charges

    since then they have reapplied £100 of charges - can i claim these back also?

    You say Eggicon asked for it, but did you agree to a Full and finalicon settlement for the present plus undertaking to make no future repeat reclaims?

    If you did, then hard to see how you can go against your own signed undertaking. Egg will produce it in court if they have not misfiled it, and you would not have a leg to stand on.

    I do not agree with the opinion given to you by mistermind, stating that you would not have a leg to stand on if you have signed an agreement not to challenge any future charges imposed by Egg.
    In my opinion it is Egg who would not have a leg to stand on. If Egg had the audacity to present your "signed agreement" to the court, you should ask the court under which law does that "signed agreement" fall? - you wont find any such agreement covered by the CCA 1974, which governs ALL aspects of credit card agreements. If it was me I would apply to the court for an order under S140 of CCA 1974 (unfair business relationships).
