You have failed to respond to our letter of the 13th June 2008 and its enclosed schedule.
We enclose a further copy of that letter although we have proof from the Royal Mail website that it was signed for on the 26th June 2008. We have been more than generous and allowed you over 14 days to respond to our initial letter to you, unfortunately you have not even had the common courtesy to try to contact us to resolve this matter amicably.
If you do not return our money to us within 14 days we shall issue proceedings in the county court and without any further notice to you. Any costs incurred by us will be added to the court claim as well as the statutory 8% allowed by the courts. We shall also be raising this matter immediately with the Financial Ombudsman, the Financial Services Authority and the Office of Fair Trading.

Yes, I sent seperate letters for both and sent them to the Harrow address - only one I have for them I'm afraid.

Ok and the finance came from GE Home Finance or was it First National?

Ok ring them and make sure they have received the letters quoting the number from your recorded delivery ticket.
Otherwise resend this time special delivery I know it costs but could be worth your while in the long run.
I found them to be quite good in responding seems strange they have ignored you.
What are your grounds for claiming please?

I have proof from the Royal Mail website that they were signed for by a K. Patel on the 26th June - printed it off in fact.
We're claiming PPI on the basis that it was front loaded to the finance agreement, we never asked for it and didn't know it was there until we received a full set of statements for the account a couple of months ago. I'm also pursuing them for their exorbitant charges for missed payments - £50.00 a time on more than one occasion.

Just rang them as suggested - they would neither admit nor deny they had received them, asked for the Recorded Delivery numbers for both letters (one for the PPI and one for the charges) and said they would look into it.

Ring them again and again until they are sick to the back teeth of you even resend the letters and when they are delivered ring them again, keep at these con merchants its your money they have.

Just rang the FSA and spoke to a lovely young man called Ainsley - they seemed most upset about GE's behaviour - am now lodging a complaint with the fos aswell.

Rang Ge Money today at 12.15pm, explained I had received no correspondence from them re; my prelim and lba - was put through to the litigation dept. where I explained everything again, was then put through to customer services where I explained everything yet again!!!!!!!!!!!!!!
Lady I spoke to tried to fob me off with the explanation that GE could not deal with this complaint as the account had been sold to Link.
Me; When was this account sold to Link?
S; Earlier on this July.
Me; This July? 2008?
S; Yes.
Me; Shall I tell you when this account was sold to Link?
S; Err, err..............
Me; This account was sold to Link on the 30th November 2007. Are you trying to tell me that Link are responsible for the charges and PPI?
S; Yes, you have to ask them why they have not replied to your letters.
Me; The charges and front loaded PPI were added to the account BEFORE 30th November 2007.
S; Link is still responsible. Let me check the statements of account online for you.

S; The charges on the account are for missed payments. They are clear and justifiable.
Me; Well I hope your company can justify them in a court of law - I have made an official complaint to the fos and I can guarantee my next course of action is to seek legal redress.
S; I need to speak to my manager.

S; My manager has suggested I ring Link Financial and find out what has happened to your correspondence.
Me; My "correspondence" was not addressed to Link, it was addressed to your company, received and signed for.
S; You have proof of postage?
Me; Printed out from the Royal Mail website for the initial complaint about charges on 13th February 2008, request for return of charges on 13th June 2008, request for return of PPI on 13th June 2008 and two lba's - one for the charges, the other for the PPI - sent out on the 14th July 2008.

S; I'm afraid you'll have to take up this issue with Link.

E: I can assure you Mrs. Deb4TLJ that we have received no correspondence from you regarding this account. If we had it would have been immediately returned to GE Money.
Me; So no correspondence was sent from yourselves to me regarding this issue?
E; None whatsoever. Your complaint is with GE Money not us.
Me; Well I did try explaining that to GE but they were adamant that your company added the charges on before you purchased the account in November of 2007.
E; (laughing) I have no idea what they are talking about Mrs. Deb4TLJ but I can assure you we have sent no correspondence to you regarding your complaint.
Me; So GE Money are basically trying to fob me off - they've lied.
E; Well, I wouldn't say they've done it deliberately...........
Me; I would. So what happens now?
E; I can assure you Mrs. Deb4TLJ that this account is now in the process of being sent back to GE Money whether they like it or not. As far as we are concerned the account is closed and any action you choose to take is against GE Money and not us.

E; The account should be returned to GE within the next 15 days.
Me; They haven't got 15 days - LBA's have already gone out.

I am gobsmacked, never heard of such incompetence.
I had a store card with GE Dorothy Perkins well my wife did anyway and that had been sold to Link but GE still refunded our money for PPI and charges and what was left after Link had their cut was sent to us by cheque, did they not give you a complaint reference number over the phone?
