Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have just become aware of the mis-selling issue, but thought 'well it does not affect me as I always say no to these products when they are offered'
However on checking through my statements/old agreements I was horrified to discover that I am paying PPI on 2 credit cards. I have had both cards for about 8-10 years, so I obviously can't recall whether these accounts were set up over the phone or by application form, and if they were set up over the phone whether PPI was discussed.
I obviously wish to reclaim these payments if they were mis-sold, but without any recollection of the circumstances that led to the PPI being included on the accounts, I am unsure how to proceed.
I am fairly certain that there are only 2 possible explanations, as I said earlier I always say no to these products when they are offered.
1) I was not told that PPI was included.
2) I may have been told that I would not get credit without it.
My first instinct was to cancel both PPI's immediately, and write to the card issuers requesting copies of the signed agreements. However having read some of the threads on here MBNA do not appear to be very cooperative on this issue (one of my cards is MBNA)
Could I write to the card issuers claiming that the PPI must have been mis-sold as I always say no to these products and 1 of the 2 cases listed above must be the reason.
I would be very grateful for any advice on how to proceed. Thank you.
Hi there, send a SARS request, for PPI, you will find a letter in the template library, that way they will have to send you all information to do with your accounts with them, and your credit agreement, there is a fee of £10.00, then on receipt of all the information you can decide which route to go down.
Thanks so much for that, the SAR is printing as we speak. One other question, can I cancel the PPI's now without giving a reason, and still reclaim the payments if the policies were mis-sold? Thanks again
Yes thats what i did. Just call them and cancel it, but make sure you record the call, you can use your phone. As they deny the fact that i called and cancelled it, and kept taking it for another 6 months.Unlucky for them, in documents sent to me in SARS was a document stating that i had called on the day i said i had.
