I have just bought a car, after the Owner had an MOT done on the 2ndJuly. It failed on its Brakes and CV Joint, so I took it to my local garage and had the problems fixed and put it through another MOT on 9th July
Now it failed this MOT because of 3 spots of underside corrosion. After speaking to the guy in the garage, he told me that this is not week old rust and this should have been flagged up on the original MOT.
I have already reported the garage to VOSA what I really want to know is, is there any compensation I can get from the original garage for not spotting the blindly obvious (which it is when I had a look when the car was on the lift earlier today)
The first thing you must do is to get VOSA to inspect the vehicle to make sure that the car should have failed the MoT at the first garage. Just because the second garage has failed the car it does not automatically follow that the first garage has done anything wrong.
If you had gone back to the first garage maybe they would have done the repair FOC to save you reporting them to vosa, as you've already reported them I don't think you'll get compensation from them now.
As gwc1000 says it's now upto vosa to decide if it should pass or fail, and it's possible they could find more faults.
Unfortunately the MOT is only good for the day it was done. VOSA, I think, will only entertain complaints if they are within 1 week of the MOT.
As to compensation...
You would need to prove that the 1st garage didn't carry out the work with reasonable care and skill and for that you would need a report in writing from another mechanic. You claim would only be for the cost of the new MOT. Although you are understandably aggrieved that your car passed a MOT, but had problems, this, I'm afraid, is a matter for VOSA. Your claim can only be for actual losses i.e. the cost of a new MOT.
Is that rust within the required rust free area of structural parts or suspension. Has the rust penetrated the body and seriously weakend it.
It could be the second garage is after work and the first garage has made no error.
