Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My sister came to see me very upset by harassing phone calls from HFO. Seems they bought debt off Barclaycard that she wasn't even aware of. between 2-3 years ago she thought she had clearesd debt with barclay card with final payment of £184.99. HFO say she hadn't and now owes over £300 in charges. As mentioned in other threads they got her phone details by sending a letter saying a parcel needeed delivering. after this she has had upward of 15 calls a day at home plus others at work (but we've no idea how they got that number).
While i was at her house they rang again and she gave permission for me to deal with them. The first person i spoke to was VERY rude and wouldn't listen to anything i said. After i complained several times she eventually tranferred me to her "supervisor". He was equally rude and unhelpful. They refuse any kind of payment plan despite my sister having given them details of her out goings. They questioned how she coped because there is always a shortfall. I said i tried to help when i could. "In that case could they have my bank details and they'd take it the following week?"!!!!!
Can't believe this company still allowed to operate. Despite telling them we won't deal with them except by post they continue to ring and my sister is getting more and more upset.
Any advice?
Your sister needs to know they will carry on hounding her - letters may help but these DCA's are tenacious. She should keep a strict log of time and date of every call they make.
When they call, she should refuse to answer any security questions, tell them to write instead then hang up.
I think there are 2 ways to d/w this problem:-
1) Reclaim all penalty charges on the a/c to reduce the debt.
2) If they are being nasty, check and see if the DCA has the legal right to chase the debt and if there is an enforceable Credit Agreement for the a/c.
So I think an SAR may be your best way forward, unless YS has her BC statements for the last 6 years.

Thanks.
Seems unbeliveable how many people have had problems with these people without anything being done to bring them into line.
Checked out links and am copying creditor harassment letter and applying for copy of original credit agreement. from other threads seems unlikely this will have much effect though.
If nothing else helps knowing she's not on her own in this.
