Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I had a barclaycard whith a balance of about 1k which could not pay back. About £900 of it was charges and interest on them. They sold the debt to Cabot and refused to enter in any negotiation with me. they kept referring me to Cabot.
I recently claimed charges from BC and they say they will pay the difference between charges and £12 (about 300) to Cabot directly :o
I do not want them to pay Cabot because Cabot has defaulted me. Cabot will not remove the default. I also want to claim the full amount.
Re: Barclaycard refunds the difference to DCA Cabot
Hi Mike,
Refuse the refund offered and tell them you want the full charges back plus interest.
They will probably agree (and may add flat 8% int't as a bonus) but they WILL use the amount to reduce the debt which you still owe on the a/c.
The only way to deal with the Default is to send a CCA request to see if BC have a proper Credit Agreement for the a/c - if they don't you can fight to get the default and any associated a/c markers removed.
You can also repay any balance you owe at a rate you can afford without fear of BC or Cabot taking you to court.
