Default TDS Case Outcomes - Links to various court cases

Our TDS case goes to court early August (LL protected deposit on receipt of court claim) so have researched as much as I can from sites such as this to use in court. Thought it might be useful to others if I posted links to the various cases that I'm aware of, especially as it seems to be quite a "hot topic" these days.

Would also appreciate any details of other cases out there that are not mentioned here, thanks.

    First successful case :

Successful case for just x 3 penalty :

Successful case won on default :

Successful case (settled at last minute before court hearing) :

Case lost on technicality about tenancy renewal :

Case lost as judge ruled claimant was no longer tenant :

Don't be disheartened by the "lost" cases because, as you will read, a lot of people think these should have been appealed !

Great post Redmax. Was going to post similar myself but you beat me to it

Can I suggest that we make this thread the discussion of the technicalities/legalities of TDS also?

Could anyone tell me what case (name) is going through an appeal in High or Appeal Court at present? Appearently there is one and it concerns a deposit paid before April 2007 and subsisting under a new agreement post 7 April 2007. There is an issue of construction of wording and facts of an agreement establishing transfer od deposit in accordance with s.213 (8) HA 2004
