Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
Please bare with the long story.
Nearly a month ago my better half decided she wanted a Renault Megane
so she went to Benfilelds and they could get her one in the colour she wanted from a different branch, with it being the end of the month she got it for a good price to,the only thing was they asked her to sign the papers before it came so they could hit there targets.
She picked up the car and brought it home(i should mention she had a drive of a car just not the car)Tracking was out miles,a crack in the windscreen and it hadn't been valeted it was filthy, big black matks over the interior roof and a chunk out of one of the wheels.
She took it back and they sorted it.
Forgot to mention it drove like rubbish to,she took it back and the dash started creaking, inside was still filthy but the black marks cleaned and drove very poorly, intermittent wiper setting won't work and the heaters sound like a helicopter landing, back it went and still the last two things are wrong.
They will exchange the car but thats all,but they are mostly full of renaults and nissans and she doesn't want either now.
She has finance too which she has been told she can't get out of,
Is there anything she can do?
Sorry for the war and piece epic
Any advice gratefully accepted
they dont sound like major faults! and they have been putting them right?
Puzzled by signing the papers? was a deposit paid. surely you pay for the car until you have got it and tried it? Is it HP or car loan?
Even if on HP you dont finalize the deal until you take possesion of the car and all the boxs ticked etc.
If on HP, they own the car, get them to speak to dealer about it.
The car is on HP,the hetaers have stopped working, air con not working properly and intermittent still not working, she signed for the car for the price she was bullied into it,the used car manager who last up untill now and a few days ago when we went to see him were offering an exchange which he has changed his mind.
Top and bottom she wanted a car in a decent state for it year if it had been there was no issue, its because the service has been poor and so many problems she doesn't want a similar car.
As said previously, get dealer to put problems right, you cant just refuse a car on a whim or change of mind!
If they wont then refer it to the HP company to help apprach garage.
or agree to get repaired somewhere else and HP company or seller to pay.
The other way is see if HP co will take it off you, snd see much they want in balance. You have a legal right to withdraw from HP agreement but there are penalties.
