    Default Hire Purchase 'cooling off' period

    Hi there, does anyone know the answer to this and what should be done next?

    My wife bought a second hand BMW recently. She saw it saw it on the website of a BMW dealer and did all the negotiations on the phone without visiting the dealership or seeing the car. This included agreeing the hire purchase, and agreement regulated under the 1974 Consumer Credit Act. The car was delivered to her at home by a 'driver' including the HP agreement to be signed. This was all on Thursday 26th June.

    She has not made a payment yet but wants to hand the car back and cancel the finance without penalty. Can she do so?

    She has received no copy signed agreement or any other correspondence from the finance company yet. I thought she was supposed to receive this within 7 days?

    Can she cancel, avoid penalty and hand the car back? Would she get her £500 deposit back? What does she do next?

    If the finance documents were signed 'off' trade premises it is classed as 'distance' selling - you have a 14 day cooling off period.
