Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I know the reclaim process for current accounts & credit cards but my partner has a loan that is near finishing with A & L. I plan to claim back the PPI as she was pregnant upon applying for the loan. She told them this but they didn't point out the exclusions of the PPI.
Anyway, my qustion is:
She missed 3 payments about 4 years ago for £65.92 each. As well as having to make up the payments she was also charged he £65.92 fee each time for missing the payment. This is the highest charge I've seen to date.
So, is there a loan templete or can a standard template be used saying words to the affect of:
"I am writing to request that you repay all the late payment fees that have been applied to my account.

I do not believe the charges reflect the true cost to Alliance & Leicster and are unfair and disproportionate. I am therefore requesting a refund based on the Unfair Terms in Consumer Contracts Regulations 1999"

Is the Consumer Contracts Regulations 1999 wording correct for this letter?

Thank you....

That is incorrect information, no way do a&l make such charges. They charge £25 for a letter if you have arrears, read your contract. You scared me!
I have worked this out time & time again -the running balance is shown increasing by 65.92 on those three accasions. I have all the contracts & loan figures & it shows an additional £197.76 added to the repaybale sum. 3 x 65.92 = £197.76.
By the way - all Terms & conditions were sent when I SAR'd them. According to section G in their T & C's states:
"If you commit a breach of this agreement or require us to provide a copy of any statement or otherwise deal with any special request in connection with this Agreement, we will require you to pay a £25 charge (or such other amounts as we may resonably from time to time decide and notify to you) to cover administration and clerical expenses on each occasion when we are required to communicate to you as a result of such a breach or in response to such a request"
Basically, it states above they can charge whatever they want to. They are to tie-ing themselves into a maximum £25 charge.
