    Default Welcome Finance need some help please

    Hi All,

    I took out 3 loans from welcome finance in 2002 and as this was before there registration with the financial Ombudsmanicon i cannot take the complaint to them.

    As the 6 yearsicon was drawing very close i had to issue my claim before the 6 years was up.

    Welcome are defending the case, the PPIicon on all 3 loan amounts total £1343.16. + £483.90 interesticon

    My main claim is that the ppi was missold due to me having a pre-existing medical condition and also that i was told by sales woman that the insurance was no longer optional and that i had to have the ppi or no loan and was also told if i cancel the ppi they will increase the interest rate.

    They are saying as i cant prove this and i signed the agreements and all there agreements say ppi is optional and therfore my claim will not suceed.

    The saleswoman also never once mad it clear that i would be paying interest on the ppi amounts.

    Does anyone have any advice or tips so i can get back the money as it looks like they are gonna win yet they were the one who ripped me off.

    you pre exsisting medical is your main point.
    these muppets are on commission
    i take it you were never asked on any pre conditions
    send welcome a letter and ask if the sales person was qualified to give financial advice
    that will give them something to think about

    be warned, they will ignore you and give legal clap trap.
    dont be intimidated and keep your thread updated

    send all correspondents by recorded/special as correspondents have a habit of getting lost with this lot

    Misrepresentation Act 1967 s2(1) as they breached Consumer Credit Act 1974. "A clause in the contract which states that a signatureicon indicates full acceptance is not valid where it would be unlikely that the customer would have the skill and inclination to go through the fine detail". See case Howard Maine v A Ogden 1975.

    They sold a policy to you that ws totally useless how can they argue I am having a problem with them they refunded on 1 account but not on my current one, do not give in I am writing them one final letter and then im off to the fosicon.
    What is you condition?

    I am currently waiting for a judge to allocate the case to the small claims track and set the dates of when to exchange documents and the date of the hearing. all this should be done soon.
