Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
"Hi,
My son has just had his vehicle clamped by Kent Parking Services whilst he
was delivering a Pizza to a customer within a gated residential block of
flats. When he returned, less than 2 minutes later, he was given a ticket by
a male (edit) from Kent Parking who then said my son had to pay a fee
of £226 for the ticket and the clamp release fee. (£85 CASH for the ticket
and £120 plus Vat for the clamp release fee, apparently the £120 plus vat is
paid to another company [we have their details.]) My son tried reasoning
with this male and said that "I have only been gone a couple of minutes. I
was delivering a Pizza" and .." how can you charge me a clamp release fee
when I have not been clamped yet" However he was abrupt and would not listen
to any reasoning and said that my son was still getting clamped. He stated
that my son had to pay up and would not let him go. After about 10 minutes
another firm arrived and clamped his vehicle.
He had to pay the £85 CASH at the scene or they would not unclamp his
vehicle. I arrived on the scene to try and talk to the man and reason with
him. However he was not there and we had to wait 20 minutes for him to
return. When he did he immediately went into attack mode (verbally not
physically - standard practice I suppose)and was rude and unhelpful. Saying
that unless the £85 CASH was paid there and then he would arrange for the
vehicle to immediately be towed away thereby incurring further costs.
Reluctantly in the circumstances the £85 was paid.
Surely there is a time limit before he can put a clamp on? The nearest place
my son could have parked that did not have any form of parking restrictions
was in a large DIY outlet about 1/4 mile away. Happy customers and cold
Pizzas don't go together!
If it had just been a simple parking ticket and the vehicle had not been
clamped then we would not have paid it. Morally we feel that this is
extortion.
The 'correct' (I assume) signs were displayed
Can you please advise us?
Many thanks"
It's easy to say after the event, but in that instance the last thing to do is pay. Your situation sounds more like a mugging than a legitimate clamping situation (not that there are many of them).
There's no chance the pizza company will reimburse you?
What's the name of the clamping company? Did you get a receipt? Is there an SIA registration number anywhere on it?
The way to get your money back is to take the landowner and the clamping company to small claims court. Do you know who the landowner is?

Your Son Parked In My N/bours Parking Bay, Which We Pay £800+ Per Year For Each Space There Are Vistiors Bays There But Of Course Your Son Didn't Want To Walk The Extra 10 Feet To The Door.
He Was Issued A Ticket And Told By The Parking Compnay That He Would Be Clamped Unless The Vehicle Was Removed, I Listened From My Balcony 10 Feet Above Your Son's Car, Your Son Used His Telephone To Call His "dad" And When He Came Off The Phone He Stated That His Dad Had Called Him #@~@~@% And Had A Go At Him.
Your Son Then Walked Off Site For About 15 Minutes And At No Time Was He Held There As You State. The Clampers Came And Clamped The Car, Then You Came Down.
Now You Haven't Been Honest Have You Because The Clampers Let You Off The Charge... And The Man Whom You State Had A Go At You, In My Opinion Didn't, He Arrived And First Thing You Told Him Was You Was A Private Investigator And An Ex Policeman Of 26 ? Years And It Was You That Came Over As The Angry One.
The Retail Centre You Claim Is 1/4 Mile Away Is 25 Feet Across The Road From The Units
I Have Spoken To My N/bour Who's Parking Space Your Son Was In And He Fully Supports The Parking Company For Taking Action Against Your Sons Car.
Having Witnessed The Whole Event, I Am Willing To Assist The Parking Company In Anyway I Can.
Interesting That You Haven't Told The Whole Story And I'm Sure The Cctv On Site Will Show Your Son Walking Off Site Instead Of Driving, He Could Of Jumped In His Car At Anytime And Driven Away....
I Was Surprised To See You Post Asking For Help Because You Claimed To Be In The Police Force For So Many Years !!!!!

I'm willing to lay odds that you already do ;-)
You say that you live on this site, however as far as I can see the OP never mentioned where this site is. I also see you claim to live on a site mentioned by another poster that is patrolled by the same people.

I have to say it's not exactly an advertisement for the moron's services. If he can't even hide his tracks on an online forum, he's not going to be much good catching your other 'alf in the act. Probably why the police got rid of him.
