I was caught on an open road which did not have a visible speed sign, I thought it was a 40 limit but turned out to be 30 and i was caught doing 44 mph.
I have put my case to the police but have been given an intended prosecution notice for 3 points and a £60 fine.
I am not happy but do not know if I can/ should fight this?
You will have passed a "30" limit speed sign when entering that zone (presumably from a higher limit that you thought you were still in) There is no requirement for "repeater" speed limit signs within the 30 zone, unlike the 40, 50,60 zones where you can expect to see the smaller reminder signs attached to street furniture along the section of that limit.
Go back along your route and you should find the 30 sign on entering that area. If you were in fact heading "out of town" and thought that leaving the residential area meant the speed limit increased automatically, then I am afraid that in the absence of such a sign allowing the increased speed, then you were in fact still within the residential 30 limit.
Thanks, I did trace the route and the nearest 30 sign is 2 road turnings away, approximately 3 miles. I had always assumed it was a 40 due to the fact that there is a 30 sign as you turn off the road I was travelling on.

That's an interesting point sellars as you are quite right to assume if you were already within the 30 limit, then there would be no need for them to display a "30" sign on entering that new road. It may be worth having a look at both sides of that sign in the side road. i.e. what does it advise as you come out of that side road onto your queried speed limit road.
The presence of lamp posts also indicates if the limit is 30mph and in some instances it does not require repeater signs after the initial posting of the limit. Were there lamp posts along this stretch of road?
Again thanks, on the lamposts: yes they were along the road. On the other side of the road there are 30 signs a little further down the road but nothing as you enter the road itself.

I recently attended a speed awarenes course for a speeding ticket along the same lines. The instructions are that if the road has street lighting then you have to assume that the speed limit is 30 untill a sign informs you differently. There are 2 downsides to this though. If you are traveling along a 40 zone that has street lighting at 30, you could be prosecuted for careless driving if you are holding up the trafic, secondly there are now a number of roads that are now 20 zones and you wont know that either if you join after a speed restriction sign.
It would be very interesting to see a prosecution for careless driving where the main evidence would be someone driving at 30mph in a 40mph zone. Speed limits are maximum allowable speeds and there is nothing that says that people have to drive at the limit. Factors such as available visibility, weather conditions, time of day, volume of traffic, condition of the road surface etc will always have to be considered by drivers to determine what is a safe speed for them.
