Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
i've just had a letter through the door from the sherriff officers demanding payment of £90 for an unpaid parking ticket i allegedly received in february.
Now it is my car, and it was outside my place of work so to be honest im not really disputing whether or not an oofence was commited, but thre was no ticket on my car that day , nor have i received any correspondence since then that informed me i was due to pay any penalty charge. As such the cost of paying the ticket has now tripled from the original £30 which ive never been given the opprtunity to pay.
We have moved house since the alleged offence occured, however we have had a redirection notice in place at the old address until last week (which is how i got the letter from the sherriff officers), so anything that has been sent should have arrived.
i spoke to the sherriff office who passed me back onto my local issuing authority (dundee city council), informing me that they merely enforced the notice and could not do anything about it, which i kind of expected. I spoke to my local authority and they said rather dismissively that they couldnt do anyhting about it and i would have to speak to the sherriffs office again, and refused to disclose any information in regards to whether or not they had attempted to contact me previously.
I phone the sherriffs office again, only to discover that.. shock horror.. they cant do anyhting about it and i should take it up with my council.
i should also point out that i have received and immediately paid a seperate pcn since this date, which surely tells them that im not trying to muck them about.
Ask them for a picture of the ticket stuck to your car. Write to the address it came from. Failing that I would honestly get yourself a lawyer and let them take you to court. Dont pay the extra fee its unacceptable and wrong
