Outstanding finance on my car I brought in April!!
Hi
Here is my problem,
I brought a Car in April for £3300 wnd just the other week it broke down, to which I cannot afford to repair.
So I put up for sale as spares or repair, which I managed to get a buyer for £1500 which I thought was better than nothing, the winner carried out a RAC check and the car came back with finance outstanding from august last year!! to which I was rather shocked at, I carried out my own check to which confirmed, I contacted the finance company and basicly I brought the car off the guy who brought it off the guy with the finance!
Now they havent helped much, they have said they will not release the title and that the guy is still paying the finance, but they cant tell me who he is, how much is left or when it finnishs.
What can I do, I have a car which doesnt move, no job, no money, now the finance company said I can sell it on and its unlikely they will repo it.
Ive read this here;
The Consumer Credit Act 1974 gives ‘good title’ to the innocent private purchaser of a car which later turns out to be subject to a claim by a finance company because of a previous, unpaid hire-purchase agreement. This means that the finance company is not entitled to repossess the car from you. Remember, this does not apply to cars which have been stolen, or cars that were subject to a lease or hire agreement.
So from what I make of this is that the finance company legally have to give me good title, as I was an innocent private purchaser, which also the the previous owner was also, as I have been in touch with him and he was very suprised and trying to find details of the guy he got it off.
Re: Outstanding finance on my car I brought in April!!
So if the original purchaser bought the car under a HP agreement, would that mean you are SOOL?
How old is the car? Do you think the orignal purchaser bought direct from a main dealer with them financing it? ie joe bloggs buys a new vauxhall zafira from his local vauxhall dealer using their own 0% finance etc
My sister had a car that was reposessed due to outstanding finance on a car. Similar situation to what I outlined but not really sure of all the details.
Luckily for her, the guy she bought it from was a straight up guy who had got into difficulties with the finance on the car and gave her her money back. She got lucky!
