    Default PCN Issued on Broken Yellow Lines

    We live in a road that only allows permit holders to park between 12 and 2pm Mon-Sat.

    This morning my partner left home about 11pm to go to work and there was a pcnicon on his windscreen. Having looked at alot of threads I think the wording used is all correct except this part confuses me:

    WAS SEEN AT MOORELAND ROAD
    FROM 09:14 TO 09:19
    DATE OF CONTRAVENTION: 28/06/2008
    CIVIL enforcement officericon NUMBER 114 BELIEVED THAT THE FOLLOWING CONTRAVENTION WAS COMMITED: PARKED IN A RESTRICTED STREET DURING PRESCRIBED HOURS

    Surely this isny anything to do with not having a parking permit as it wasnt between 12 and 2pm?? It could however be something to do with the fact he was parked half on a yellow line - BUT this yellow line is very badly broken so you cant even tell where the line starts!

    If it is because he was on a yellow line, shouldnt the wording suggest this?

    Also, it says the full amount of penalty charge is £120.00 but will be reduced by 50% to £60.00 if paid within 14 days.

    I would obviously like to challenge this PCN but I havent got a clue what to say in my letter - any help would be greatly appreciated!

    The ticket is for parking within a controlled area, and as you suggest, nothing to do with the parking permit (which is neither mentioned or valid for the hours you stated).

    Moving on to the lines themselves, the fact they are broken doesn't invalidate any parking orders, the paint simply reminds the driver to check the adjacent plate(s) for the relevant parking restrictions that apply. So, even if you could fit your car or bike in a gap in the lines (say a utility has dug a trench and relaid the tarmac with no painted lines, you would still correctly be given a ticket, as the area was within a controlled parking zone. There may be grounds of appeal if NO yellow lines are evident and you could reasonably assume you didn't believe any parking control indications (plates/lines) existed, but this isn't often successful.

    If you can post up a copy of the PCN (both sides) it can be examined for any possible errors. Remember to obscure any identifying details first.

    It's also with contacting the council in question for a copy of the Traffic Regulation Order for the street or zone. Sometimes these are no existent or wrongly worded or not valid for certain days or times.
