    Default FRUITBAT v BARCLAYCARD - LET THE GAMES BEGIN

    DPA letter sent to Barclaycard this morning, recorded delivery. Expecting same response as everybody else seems to get regarding information on microfiche blah blah blah.... Has anybody found out where we stand if they take this stance - I bet they would be able to get hold of pre-2004 statements if it was for their benefit! Will keep you informed of progress

    This morning I received statements dating back to June 2004. After reading Lynzpower's thread I have decided to claim the £240 from the last 2 years statements and then request copy statements at £3 each and file a further claim at a later date. Preliminary request letter to be sent 14.7.06.

    Yesterday received response to my request for refund of charges saying they disagree with my legal analysis but as a sign of goodwill are willing to refund £96, this being the difference between each charge levied and "the £12 recommended by the OFT" (I think not). Am intending to reply along the lines of "am pleased to accept the £96 as an interim payment but will be seeking the remainder through the courts if necessary".

    Is this the right course of action?

    Received the expected reply to my lbaicon this morning. They say the charges incurred are in line with the agreed terms and conditions of account and I may be eligible to refer to the Financial Ombudsmanicon Service, They will consider the matter closed if they near nothing within 8 weeks. I will be filing my moneyclaim on line beginning of next week but I'm feeling very nervous about it all. Will hopefully, be able to find a court buddy in North Essex area if it comes to it. Onward and upward then.

    Got latest statement today showing that they have credited the £96 (accepted as only a PART SETTLEMENT) to my account. When it comes to filing MCOL next week do I just work out total charges + 8% interesticon and then take away the £96 to get total claim amount or do I ignore the £96 for now and assume that Barclaycard will deduct it from the nice cheque they will be sending me in the near future? HELP PLEASE.
