    Default Nightmare car & SOGA

    Hi All,

    First post here as I stumbled across the site whilst searching for info on the SOGAicon. I think I have a decent understanding of it, but thought I would post my issue here to see if anyone else has suggestions/kind words!

    I bought a VW Golf 2 months ago from a Jag dealer. Showing 84,000 on the clock, FSH, recent MOT and the garage told me they would do a full safety check before it left the building.

    Fast forward to now and the car has the following issues: (I requested a full inspection at my local garage after some of them came to light)

    1) Power steering rack leaking
    2) Power steering pump leaking
    3) Rear axle bushes separated
    4) Front outer CV gaiter split
    5) Both front wishbone bushes separated
    6) I just paid £130 to get an engine coil replaced due to misfire (it was this incident that lead to everything else being discovered)
    6) The gem of them all...the car has been clocked!

    I discovered the car had been clocked by doing a check on previous MOT records and it's as clear as day. Kicking myself for not doing that at point of sale but I was buying from a dealer and felt "safe". The mechanic that checked the car said he feels all these problems were on the car before I bought it.

    Anyway (long first post this!) contacted Trading Standards who advised me to first phone and talk to the dealer and if he didn't play ball to put my complaint in writing. I've spoken to him and emailed him my list of issues, advising him that I've spoken to Trading Standards and I'm due a full refund under SOGA. I'm about to draft the "official" letter now to send recorded on Monday.

    Trading Standards have also said they may be interested to proceed with a criminal investigation and they're quite happy for me to tell him that. At the moment he's telling me he's investigating it from his end, my response to that was he can investigate as much as he wants - I'm still entitled to full refund and expect as such...and fast.

    So after all this waffle has anyone got any thoughts as to anything else I should be doing? Am I going about this in the right way? Wondering if others have been in similar situations and had a good end result.

    Hi

    Not sure how to post a new threadicon.
    Not sure if anyone can help.

    I taxed both mine and my boyfriends cars which were both on finance paid for by him, we have recently split up and the finance company are about to collect my car as he has not been making the payments. Is there anyway i can dispute both sets of tax as both cars are not in my name and i am not able to drive either??

    Yep IMHO you can claim for refund under SOGAicon, but dont let them keep putting you off or delaying it. You need to let them no you will take them to court. Give them a deadline to refund monies etc. by way of lbaicon leteer before action. Suggest you dont use the car anymore either.
    Keep TS informed of what you are doing, copies of anything you send and receive.

    It is important that you don't use the car.

    Don't jump in with legal action too soon, give them a chance to investigate, it could have been a salesmans private sale and they wont be too pleased about their name being tarnished if it turns out to be.

    Do all your corresponding in letter (recorded deliver) from now on.
    I would not give them more than 7 days to get back to you, contact them again if they have not.

    You may not have any need for further action once they contact you.
