I wonder if anyone knows what the Scots Law equivalent of the Administration of Justice Act 1970 is please? My problem is that the BOS have no credit agreement for a loan - they are not pursuing me - but they keep sending statements showing they are still adding interest to the unenforceable account. I am writing directly to their CEO Andy Hornby but I need to know what statute they are breaking in continuing to add interest.
Bumping in case Rory is around. I have been doing a bit of checking and I think the CCA 1974 covers it in that they cannot enforce the account whilst it is in dispute ie they cannot take ANY action on the account, including adding interest or charges. I will go with that one.
