When OH found himself in the financial doodoo last year, I noticed he had payment protection on most of his credit cards and automatically wrote off to them requesting that this be cancelled. All of them wrote back saying this would be done.
However, going through some old correspondence over the weekend, I discovered that he had in fact written to most of them about 2 years ago (September 2005) advising them that he was now only employed on a temporary part time (approximately 13 hours a week) basis and he didnt know whether the PPI should still be applicable especially inasmuch as most of his income was now made up from an occupational pension as he had been retired from his original employment due to an injury/operation that prevented him from working in the industry he was in.
It would appear that he received no replies from any of them and PPI was continued.
Would he be able to make a claim for the PPI payments from the date he wrote to them. Unfortunately I cannot find any proof of postings.
There does not appear to be any policy documents relating to any of these insurances apart from one company, Tesco.
Also having just had his complaint against a frontloaded policy from an HSBC loan upheld on the grounds that it was mis sold due to his health problems, lack of information and hours of working. Should the companies have sold him these policies in the first place ?

Have just discovered that it can be proved they received the letters as they accompanied the monthly payment by cheque and this is noted on the letter and the cheques were cashed.
So should an attempt be made to recover the PPI premiums from September 2005.
Any advice welcome.

I sent S.A.R. letters off to 3 Credit Card Companies.
Credit Card Co. "A" - provided a summary of statements with no interest showing, just payments made, balance and PPI payments. I wrote back requesting they provide details of Insurance company giving a further 14 days to respond. No response. I have 6 statements that show 3 x interest rates - Purchase Interest, Cash Withdrawl interest and Special Balance Transfer interest all at different rates.
Initially this card was taken out for transferring of other Credit Card balances, so I am assuming that would be the Special Balance Transfer. Up until about 2005 the balance was just being paid off, no other transactions were made. From 2005, OH started to use the card for purchases and cash withdrawals.

On what basis are you claiming that PPI was mis-sold? Normally, it would be that the insurance was inappropraie in that you were not eligible - eg you were self-employed, on benefits or retired when you took it out. That cannot be the case for you as they did pay out.
As to your question - if you do think you have a legitimate claim, then you should proaly use the rate of your card.

Reason(s) for mis-sell - In the first Instance, OH was advised, the account couldnt be opened unless it was protected by the PPI, it wasnt something he would have taken out.
