ive just got my statement and i went £1.75 apparently (after interest and charges) and have a £12 charged added(now £13.75 over) even though i pay by DD and did an extra payment of £5,so i called them up to ask about it and apparently i need to pay £30+ DD to not go over my limit again next month as i will again be charged £12 for going over the limit this month(even though this months charge is for that).

surely this is wrong, as they ineffect always charge you £24 (2x£12) for a charge as there is no way of paying to stop it as the statement is always after the event has been added.

is this there new way of shafting us? is there anything i could do?

Best thing is to submit a Subject Access Request for your statements under the Data Protection Act - the template is in the templates section, which will cost you £10.

When this arrives if it doesn't include manual intervention sheets - write to them stating that you don't consider the request fulfilled because of their absence. After 40 days they commit and offence if this is not fulfilled (though its unlikely they will).

The manual intervention sheets can demostrate whether a process such as a late payment, or over the limit charge is fully automated - hence why the banks are extremely reluctant to part with them despite you having a legal right as a subject to them.

Total up all your penalty charges.

If money is a bit tight I would suggest going to the Financial Ombudsman Service.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.
