    Default car bought on finance

    Hi all

i bought a import mr2 on finance june last year, it came with a 6 month warranty,12 month mot and 6 months tax

within the first month i had to change the clutch cost me nearly £500 and the front suspension was knackered and banging on every little bump,

i rang the the warranty company who said the clutch was wear and tear and the suspension springs were the only thing included in the warranty, so i did not get the suspension done

i rang the motor company i bought it from and they said the same but to bring it down for them to look at but would not pay for expenses they are in birmingham and i live in southwales. i also noticed that the mot cert had holes in it where it had a staple put through, usually this means any advisories were stapled and removed so not to see, so i checked on the vosa website and the car had failed its mot on front suspension struts leaking, i had it inspected by my local garage who did the clutch this was about 2 months after i purchased it and low and behold they said both struts were leaking and the one was totally knackered (this one failed on mot sheet)also drop links were knackered to

how was the mot issued ?? if the work wasnt done

i rang them back up and they said that the work had been done and that it had a valid mot cert.

can i do anything about this as i do not have a receipt for the clutch but the garage say they can do me a confirmation letter with date to prove the work was done.

the car has been a nightmare i now have to replace lambda sensor, knock sensor, droplinks, struts which will cost me hundreds.

just want to know if i can do anything about the clutch and suspension surely this is governed by someone

I think it is a bit late now to do anything. your chance was when you had it inspected when the clutch was done. then you could of taken it back and got it sorted, the dampers/suspension that is!
You could take them to court but you did not give them the opportunity to rectify the problem.

    Hello simpson eh,

On the BBC 1 "Don't get done, Get Dom" tv programme today there was a case just like yours. However the car had only been purchased about five months I believe but Dom implied that if the car is on finance then it is down to the finance company to sort problems out right up until the last payment!!! I have never heard of this before but they spoke to some legal chappy and he confirmed it. Then the finance company paid over £1100 for the car to be repaired and returned to owner!!

Only applies to hire purchase agreements, not car loans or bank loans.
As the car belongs to the HP company.
