Civil Penalty Notice From Disabled Bay without Blue Badge
Hi All,
I'm new here but I've read a lot of peoples threads about similar problems but I'm still a little confused. Here's my predicament:-
I went the gym today and parked outside in the car park that serves my gym, bennetts,bath stores,currys etc. There is a sign in the gym that say you need to sign your vehicle in if you stay for more than 3 hours, otherwise its free to park there(no idea how much it is after that).
Anyway, I recently had surgery on my knee and I have to go to the gym to do stupid exercises every day. I have real problems getting in and out of chairs(and cars), so today I didnt even think about it but I parked in the disabled bay right outside the gyms door. There are always people in the disabled bays without badges.
It takes me about 5 minutes to get out of the car as my knee locks at 90 degrees.
The car park has maybe 150 spaces and there was about 20 cars in it.
I thought I arrived at the gym at 9.30am, when I came out a few hours later, I had a Civil Penalty Notice (for £30/£60) on my window from Town and City Parking Ltd, saying that I'd parked in a disable bay without a badge(guilty), the funny thing is the ticket said it was issued at 9.15am.
Stupidly I didnt swipe my card in at the gym as the gate was open but I'm sure I was still driving there at that time.
Now here's a few things I need help clarifying.
1. As this pcn was issued by T&C Parking, does that mean I can just wait for them to write me a letter for the £60 then write them a letter saying that they need to contact the driver not the registered owner(which is me as well) and the whole harassment thing and then forget it?
2. I read somewhere on the forum that disable bays in private carparks are not a legal requirement but a courtesy, so this ticket would be invalid any way, is that true?
3. As I dont think I was there at that time but I've got not proof to hand, would it be invalid if the ticket is written 15 minutes to early?Might be able to get the CCTV from the gyms entrance.
4. If I did get there at 9.15 the [edited](wardern) would of had to of watched me struggle to get out of the car and he would of seen me walk 5metres into the gym, surely they should have to point out to the driver that they have failed to put their blue badge on display?
5. Lastly and maybe the most interesting one, the contravention code H simply states "DISABLED BAY - NO BADGE", it doesnt state what type of badge, so in theory could I stick a blue peter badge in the window next time and stay that a badge was displayed
