Help. first post after an unfortunate incident at the weekend and have come across this site !
So can anyone signpost me to some advice concerning a ticket my daughter obtained whilst taking my wife shopping @ tesco, my wife has recently undergone surgery for a long standing illness and is by definition (Disability Discrimination Act) disabled having very poor mobility My daughter explained that the disabled bays had no signs at all indicating blue badge holders only and she assumed as mum cannot not walk very far that she could park in a disabled bay ( I, doubted this at first went to the car park and checked and now have the photographic evidence that their are no signs and also challenged the manager @ Tesco to show me the signs which their parking agent relied on for the parking ticketthey could not (as they do not have any signage stating blue badge holders only ). After shopping for no more than 40 mins my daughter and wife returned to have a ticket fixed to the windscreen stating : 'not displaying blue badge' well no signs stating that you have to display anything let alone a blue badge means that the breach of contract that Euro 'p' cold rely on to recover any damages does not exist. Am I correct?
My wife is beside herself and my daughter just wants to pay the £50.00, I however, on the prinicipal that the ticket has been incorrectly applied am confident in winning any challenge these chancers may wish to throw and beleive their may well be a case against Tesco under the Disability Discrimination Act also!.
Can any one advise - does the 'no signs' - 'no contract' breach case principal stand up !
If so, am I right in thinking do nothing until they contact my daughter or should I start challenging them directly right now !?
