Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
The block of flats I live in has a private car park which requires everyone to display a permit. It is 'policed' by us ... we are all given a bundle of parking tickets and told we can use them on our neighbours' cars for whatever reason.
Today I received 3 letters from ParkForce saying that on 3 occassions I was not displaying a permit. I have never had a ticket placed on my car and it has always displayed a permit.
I looked at the tickets we are given, and there is no space for an address, so there is no way of tracking down who they came from. I suspect it is one of my neghbours who I had a mini dispute with because they kept parking in my allocated parking space.
Obviously ParkForce is requesting money and threatening court action and, while I am confident that I can fight and win, it is still quite stressful. Is there anything I can do as I suspect there are more of these letters on their way to me.
If I send ParkForce a copy of my permit, do you think they would stop the current letters and any future ones? It seems wrong to me that I now have to fight someone possibly in court due to one bitter neighbour holding a grudge.
Ignore them. Thats the most ridiculous method of policing a private car park I've ever heard(by people who have no idea of the legalities behind - although you could argue that about most PPC's ), and there is pretty much no question that it would never stand up in court. IMO, bin the letters and ignore future ones.
If you really wanted to reply, I would probably just reply with a brief, to the point, letter, asking them to prove the contract you had entered into by parking there, and also to prove the alleged breach of said contract. They cant do either, so will soon shut them up.

What an extrordinary system!!
Send them a photo of the permit on your car and ask them to produce photographic evidence of the three occaisions showing that there was no permit displayed
Hi,
Thanks for the response. It does seem pretty ridiculous to me too. I'd always assumed that tickets would be traceable back to the person who issued them.
If I was actually getting tickets stuck on my windscreen, then at least I'd have a fighting chance of capturing it on camera and knowing for sure who is doing it. Instead, I just get letters threatening that I pay up or a court will insruct bailiffs to seize my property.
Thing is, even if it was traceable, its still TOTALLY unenforceable. Do not be bothered by these idiotic attempts to get money from you.

If you ever do receive a court summons, please let us know.....I want to be available to hear how loud the judge laughs

Sorry to bump an old thread, but I though I'd report back after the great advice I got on here.
I ignored the letters I got from Parkforce as suggested but unfortunately they followed up by getting 'debt collectors' to ring our home multiple times each day chasing for payment.
First off, I wrote to the debt collectors and referred them back to ParkForce as I told them the matter was in dispute. I never heard from them again!
Secondly, I wrote a letter to ParkForce using some of the templates from this forum. Again, I never heard from them again (has been about 4 months now).
Luckily, I have had no more parking tickets and everything is good. A result!
Thanks again to MrShed and Michael Browne.
My next attack for 2009 is the credit card charges
Sorry, obviously an old thread but just seen it! Good result, and you are welcome
