Thread: Excel Parking Services Peel Centre Stockport

I made the aqaintance of the above named compant today. I foolishly did not know that a parking ticket had to be purchaced as I thought it was free to park in the retail area. I went in to Comet to pick up a microwave oven and was a little over ten minutes. As I was waiting for my puchace to be brought to the door I noticed a man in a high vis vest loitering near my car writing in a pad. I went straight out to talk to him and said I had only been ten minutes and was leaving he said it was too late and pointed to the ticket on my drivers door. When I opened it it was for not displaying a ticket and had the time observed at 12 minutes. I understand the grounds for issue but as I have read on your fine forum this is irrelevant. I plan to take the route many of you have as outlined in the stickies. Any more recent pointers to help me out please? I just do not want to pay out of the principal.

Thanks, I drive a company car so when they request my details from the DVLA all they should get is the lease company who will possibly pass on the company name? Should I speak to the fleet manager and ask him to refuse to give my details? Will they then pursue the company for payment? I do not want to start trouble with my employer.

check your lease agreement now. many have words about fines and penalties being paid by the lease company which they pass on to you along with a "handling charge".

you should be able to stop them with a well worded letter fax delivered ASAP if needed.
some lease companies have a list of companies they will pay etc.

let us know exact wording of lease.

The fact is that the RK has NO liability, and if the RK is the lease co, then there is no question that they were driving, hence they cannot have entered into the supposed contract with the PPC.
The lease co could also be seen as complicit in illegal activity where they pass on a demand containing one of the frequently - used illegal terms the PPCs use - claiming it's a penalty, a pcn, RK liable etc., and may be opening themselves to legal action.

Ok thanks I will check the lease 2moro, I seem to rememebr that they pay speeding fines etc but tend to pass the parking ones on. But i will make sure. The company we use is Lloyds TSB.

Must be the other way round - you can't pay speeding fines for somebody else, as these also come with licence points.

If they usually pay parking fines (and then pass on the costs with or without an 'admin' charge) then it is imperative that you alert them to

a) the non-liability of the owner/RK;
b) the unenforceable nature of the demand;
c) that it is not a lawful fine or penalty as a private company cannot, in law, levy these and therefore outwith their lease conditions for paying and charging;
d) that paying will be solely at their cost and will not be recoverable;
e) that releasing the details of the driver will be seen as a breach of the Data Protection Act;
f) any assistance given to the private parking company in identifying/harassing the driver could be seen as being complicit in a criminal act.

If your company are the lessor, then you also need to inform your fleet manager and payroll, in writing, of the above and that you specifically do not authorise any deduction from salary pertaining to this matter.

nor can the lease company bind you as a third party to this alleged contract.

my wife went shopping back in october to the peel center in stockport with our 11 month old daughter.
she parked in the peel center car park purchased a ticket then went on to shop.
As she returned to our car she noticed that there was a parking attendant putting a ticket on the car!
anyway to cut along story short she closed the car door on going shopping the ticket blew away!
this is the reason she received a fine.
but on explaing to the attendant what had happend HE GAVE MY WIFE A VALID TICKET and said "sorry love you might of had a ticket but i cannot reverse this one but you can appeal this fine"???
so i have kept both the valid ticket and the fine and have now been issused with a £100 parking fine from excel parking!!
shall i just keep on ignoring these numpties???

Evidence is neither here nor there. The £100 simply isn't enforceable in law.

i work for excel at peel centre stockport its 50p for 2 hours parkin we take picture of the cars we put ticket on 6 to 7 pictures there are 64 sign to tell people its a pay an display cant people read

excel only get the fine money not the machine money they only pay us 5,80 a hour

Take note of the apparent poor educational skills shown by this Excel employee. That sums it up neatly.

5.80 an hour. and the two owners pull down 700k a year between them. Excel has the money to pay for very good legal advice, and they still get hammered in court. No more need be said.
