    Default Free Shop Car Park

    This might seem a wee bit selfish but I work next door to a big shop with a large car park atthe back. This car park is used by a lot of people (more non customers than customers - ie there is a church, mother toddler group next door and it is always extra full when there is a funeralicon/ playgroup days) and I have parked there for the last few years as it is the only place to park nearby for more than an hour which is handy for work. There are no signs saying that it is for customers only, just a sign warning that you park there at your own peril etc. Was recently told off for parking as am not a customer (although i do pop into the shop at least 3-4 times a week! - its a clothes shop im a girl!) by a member of staff but continue to park there as I am not the only one (I recognise all the car owners from surrounding businesses) (and its convenient!)but apparantly the only one asked not to park. It is a free unmanned car park and just need to know is there anything they can actually do like have my car clampedetc or can i (selfishly at the cost of customers) still park there and put up with the dirty looks ? lol!

    It's not a "free unmanned car park" it will most likely be a piece of private land owned/part of the lease by the shop owner, and intended for customers, but so long as no signs are displayed saying it is for customers only, your free to use it with out concerns, can't clamp you without displaying warnings, and can't do anything else really unless warned by signs adequitly displayed.

    And even if signs are displayed, still in my opinion and many others here, it is free to use.

    Trespass

    As applied to a piece of land open to the public which is not common land, open access land, or a public right of way. This is also one area where the laws of England and Scotland are significantly different.

    It is against the law to trespass on any land (and inland that includes land covered by water such as rivers or lakes) or in any building. Ignorance of that fact is no defence under this law. The word trespass covers much more than people usually realise. All land in this country belongs to someone.

    If you go on to land without the owner's permission, you are trespassing unless there is some right of access for the public, or for you specifically (for example if you have acquired a right to pass over the land to reach some land of your own). Any person can enter a place if the landowners permit it. However, this does not necessarily make a permanent right of access, and unless they have dedicated a bit of land to be permanently open it is within the power of the landowner to ask any person to leave, assuming that person does not have some other lawful reason to be there.

    The landowner does not have to give a reason. If the person does not go immediately, by the shortest practical route, then they are trespassing. Despite the well known sign ‘trespassers will be prosecuted’, trespass is not a criminal offence and trespassers cannot usually be prosecuted. They can, however, be sued. There is little chance of such a matter ever being so serious as to be worth suing over, and so this rarely happens.

    So it's not exactly 'free to use'.

    They should put signs up for a clamping company and if you park again you should be clamped/towed away .. I can guarentee you will not take advantage of their good will/lack of knowledge of what they can do ever again when hit with a bill of a minimum 75.00.

    You are very selfish.

    Whats the contact details of the shop and I can call them to try and get a sale (ok .. long shot but you have to ask)

    I don't believe it. This wheelclamper is touting for business on this site. It makes him even more ridiculous than he already is after his posts on the Perky thread. HE calls people selfish, what a joke. Chocolatelover take no notice.

    cheers fridgedoor just to clear things up when i say free i just mean there is no ticket system in place and obviously unmanned i just mean that there is no warden walking about. Tis i nScotland dont know if that makes any difference. they have not put any sign up - in fact the only sign is from the previous owner of the shop saying that the car park is owned by the previous owner and park at your own risk.

    The parking is not free its paid for by the genuine shoppers at the store and included in the cost of the goods.
