    Default UKPC and leaving the retail park (which used to be free until now)

    I have been reading through the threads after I got a parking ticketicon. I could not believe it and wanted to fight it as it just seemed upfair nowhere on the notices did it say you can't leave the retain park.

    I have not received my 'invoice' yet but no doubt it will arrive. My offence was leaving the retail park, crossed over to another park to recycle bottles in the bottle bank. I am the Keeper/owner. I am getting a bit nervous ignoring the fine and engaging with them. I know somewhere in the threads there are people in the same situation but did not find what happened to them.

    My question is do I follow the same templates ie tell them to write to the driver etc as i was the driver.

    Thanks again for the excellent postings on the web site.

    • Do not pay
    • Do not contact them
    • Ignore any letters you receive, no matter how threatening
    • They will go away after 4 or 5 letters

    Simple!
    It's a [problem] - don't engage with them. It doesn't matter who the driver was really. What gives them the right to fine anybody? Nothing does.

    Hi,

    The reason why you did not know what what happened is that they have followed our advice and ignored the companies concerned. There is no actual dramatic conclusion. Once they get the message that you are not playing, the PPC goes away to find someone else to annoy.

    You will get landfill through the post but stand firm and ignore. With the UKPCs & Euro Car Parks of this world it is probably best to just ignore [saves postage]. The smaller companies do fly a kite in the courts occasionally and with these these it is probably best to use the templates - your call entirely.

    When you get a letter claiming to be from a debt collectionicon agency, use the template for stating the debt is in dispute - refer back to UKPC.

    Don't dream of paying
    Do not get involved in any "appeals" process
    Don't worry - be happy

    Unless there is a signed contract or a debt has been crystallised in a court judgment then no 'debt' exists in my view.

    I am pretty sure there is good case law on the crystallised thing....

    Yeah, I think you are right lamma, I should have said that the "debt" is denied, dispute is not a strong enough word.

    I would say that

    "The existence of any alleged debt is not shown. Produce physical evidence of a debt, which for the avoidance of doubt can only exist as a product of a written agreement or a Court decision. Refer to your principle to obtain such evidence.
    Any further contact whatsoever in relation to this matter in the absence of ANY proof will be regarded, inter alia, as Harassment and Fraud"

    Hi again,

    Thought I would send an update. Sent a standard letter asking them to send the charge/ notice the the driver of the vehicle. I was apprehensive about letters coming in but to date have not heard/ received any letters after the initial invoice asking for payment.
