Thread: Recall Of Decree

Hi guys I wonder if someone could give me some advice.
I took Reid furniture to court for the misselling of PPI.
They did not defend the case and a decree was awarded to me.25th April
I then instructed sherrif officers to charge for payment of money.
Today is the last day.
A letter arrived from a solicitor this morning recalling the decree.
I know have to go to court on the 27th june and do it all again.
Anyone ever gone through this.

Its for 332 pounds (my pound key isnt working)

Anyway the decree was granted and I had paid the sheriff officers in Glasgow to go and get my money.
Reid Furniture who are a large company and are still going decided to hire a lawyer and recall the decree.
They are saying that they informed GE Capital of the dispute and it was up to them to defend it as they had given me the finance. (in all the letters they wrote to me to tell me to go away GE Capital was never mentioned. I have 6 letters and 5 emails from them)
They are saying that I should have gone to the fos and not taken them to court.
They are saying that I was covered with this insurance and should have cancelled within the 21 days.
This is nonsense Reid furniture salesman sold me the PPI.
The salesman told us the day we bought the suite that we had to take it out. I argued with him that day I told him we dont want insurance he said well I can tell you that If I go back to the finance company they might turn down your application. We had been in the store over 2 hours at this point and just gave in.
I also found on the net that they have done this before...

I telephoned the court today and they said I have to appear on the 27th June.. Im sick now with worry
