    Default HELP please

    Hi everyone,
    I am new to this so hope you won't mind me telling you about a problem I have and if anyone has any ideas I would really appreciate some help.
    I purchased a car from Approved Car Finance in 2005 on finance through the Funding Corporation. On the day I bought the car I took out payment protection insurance. I told the salesman that I wanted to make sure I was covered for anything that might happen in the future to ensure the payments would be covered. He assured me that I would be covered for the whole 5 years for everything. I did not receive the policy for some time afterwards and must admit I believed what I had been told and I didn't read through the small print.
    Last year I had a bad accident and injured my leg. I had an operation that went wrong and have had to give up my job and am now disabled and awaiting further operations. I will not work again. I put in a claim to cover the repayments on the car which was successful and Direct Insurance paid the monthly instalments. Last month I received a letter from the insurance company to say they would no longer be paying the instalments as 12 months was up. I telephoned them and they said they only pay it for 12 months. I explained what I had been told but although they seemed sympathetic said there was nothing they could do. I rang the Funding Corporation and explained I was now disabled on benefits and that the insurance was refusing to continue the payments even though I had been assured when I bought the car that I would be covered. They were very unhelpful said there was nothing that they could do and if I didn't pay they would take me to court. I asked if they would take the car back as I had been told the finance was secured on the car when I bought it. They told me they couldn't take it back that it is not an HP agreement on the car but a credit agreement and that was different. I asked if they could do anything to help me and was told no, just pay up. I asked for a settlement figure which turned out to be as much as the car cost originally even though I have paid 3 years. I thought if settlement figure was low enough I could take out a bank loan at a much lower rate of interesticon and pay the car up. I have contacted Approved Car Finance who said they can't do anything and won't accept any responsibility over giving me false information.
    I am now so worried and don't know what to do. I can't afford these payments and no one will help. I feel like I have been taken for a ride as I did everything to ensure the payments would be covered if anything at all happened.

    Hi, have you got a copy of the agreement? If not you need to get one.

    If they are adamant it is not HP (and they can't take the car back once you have paid more than 50% of the HP anyway) then you can probably negotiate a lower payment, frozen interesticon in view of your circumstances. There are letters here that can help you:
