Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I'm new here and find the advice really useful, however there is one point I would like advice on. My car is leased so the registered keeper is the Lease Company, I travel alot in the course of my business and the chances of picking up a parking penalty from a PPC are fairly high. If I do the Lease Company would receive the charge notice and are unlikely to fight it as the members of this forum would, i assume they would simply name me as the driver. Anybody else been in this situation and had a parking penalty, if so how did you deal with it.
You may be the leasee, it doesn't make you the driver, unless your lease specifically doesn't allow you to have another driver using the car. All the PCC can find out is that you lease the car, that still doesn't necessarily mean you were driving the car, so the normal advice would still stand.
I have a car on lease with Motability, and when I got flashed by a camera, Motability passed the details on, and the police contacted me directly and I dealt with the matter from then on, I would imagine the same scenario would apply to you.
Apologies to people who I was in the process of helping, I may be gone some time.
In the case of a NIP the lease company HAS to pass the paperwork on.
But for council fines and PPC invoices they may may just pay up and then pass on the fee and also charge you a handling for for the privilege - nice !
Check the wording of your lease VERY carefully. some are phrased as a catch-all, others are more specific. If in doubt post up the EXACT wording on here.
