Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
hi to everyone this is my 1st post!! last oct/nov a bailiff came to our house with regards to unpaid council tax,he then asked for us to sign for an agreement which we did (I KNOW STUPID OR WHAT) we were not aware what this was, also that night we gave him 80.00 in cash the debt was 1,400. well without going on too much the payments were not kept to,my husband & I have subsequently seperated, the bailiffs have now arrived saying they want ALL the money which has now miracuously risen to over 2,100!!!!!! I explained i was not in a position to pay the amount in full, that fell on deaf ears i was told to ask my friends !!! i gave them another 150.00 I took a weeks holiday so I'd get 2 weeks wages and gave them 150.00 they said she would give me a couple of days to get the rest...i simply do not have the cash nor can I obtain it,they will not accept monthly/weekly payments as they say I failed on the last agreement.I explained I am on my own now and asked them to be reasonable ( I KNOW STUPID OR WHAT) so where do i go from here they have just called again and said they will be back on tuesday between 3pm-8pm...one more point dont know if this will alter anything...but the bailiffs concerned have changed names..same address but trading under differnet name? also agreement was signed by both myself & husband can I not have an agreement in my own right?any help advice greatly appreciated ps any body know any BIG BODY BUILDERS!!!!!!
can not remember name on 1st visit & husband thinks he may have taken paperwork with him when he left, but now called Excell but as I said before it is the same address.
If the first visit was from Drakes or the likes, then I assume you have signed a walking possession order. If this is the case they can legally force entry into your home to recover goods.
Do you have anything that they may take. TV-Sound System-Computer- DVD etc?
I believe that the date of the warrant might be important, as far as I am aware there is a 180 day time limit on the warrant.
There are some good bailiff experts on here, if you sit tight one of them will spot the thread.
Please note: I give advice, in good faith, based on my reading and experience. Please satisfy yourself, that any advice given is accurate in content before acting upon it.
really cannot recall the name they went under last time,i have a tv, lap top,dvd player that doesn't work too well i'll check the date of visit 180 days if thats right i could be close!!

I'm midway through the tunnel, but getting closer to the light.
the bailiffs have now arrived saying they want ALL the money which has now miracuously risen to over 2,100
bailiffs can not just add charges to accounts. They are limits to what they can charge for and how much - I would certainly question the amount that is now being demanded.
they will not accept monthly/weekly payments as they say I failed on the last agreement.
They are still legally obliged to accept any offer of repayment by installments. This refusal of accepting repayments is a common tactic used by bailiffs unfortunately.
do i carry on with payments to council even though they wont help?
Yes at it shows a willingness to resolve the matter. Can you still afford the amount that you offered? What you also need to do is send a SAR to the bailiffs in order to ascertain why the account has risen by so much.
please can anyone tell me if I should call the bailiff or just wait for the information I requested in my letter?
Personally I wouldn't call the bailiff as this will probably be a fruitless exercise. There are no records of telephone conversations and anything stated in a phone call can be denied. I would keep everything in writing so that there is a record any communication and what was stated.
re reply from rippedoffagain is the 180 days on the warrant correct the day we signed the walking possesion order was 8th november so more than 180 days ago ...... i have also paid the money direct to the council online as advised....Thanks in advance for all replies.
I wrote AGAIN to bailiffs explaining i would not be telephoning the bailiff as i had requested copies of charges, visit times, certifaction etc etc they have sent same letter asking me to phone the bailiff?? are they being awkward just for the fun of it??? I thought they HAD to supply me with this information?? what course of action should I now follow? Thanks in advance for all replies.....
yet another letter telling me to telephone bailiff has arrived today, i am just continuing to pay the council online is there ANYTHING else i should do?
