    Default Abbey have settled


    I am unfortunalty new to this messaging
    but if anyone thinks ive got a case,i would like help

    in january i was charged(comming off in feb)£450+interest .i complained telling them there insufficient funds in my account because of an error of theirs and they admitted they never cancelled the correct direct debits .
    therefore they refunded my 450 but kept the interest.as i went over my overdrafticon because they never stopped the debits but paid them out of my account (and then used their money to pay others).
    OVER THE LAST 8 MONTHS I HAVE HAD £1235.39 IN CHARGES
    I have managed to get many if not most refunded as they were the banks fault .i.e.computer system was not working ALL weekend
    but i find it all so stressful and i really dont think i should be spending hours on the phone every month sorting it out.i have a full time job and a 3 year old daughter i dont need this crap.
    i want an appoligy and the time back.It has caused so much strife with my partner.and ive been in tears so many times
    It may be fine to charge someone who earns £100000,£2000 a year in charges but not a family who has only £15000

    How much in charges did the NOT pay back?

    Have you another account to get money (wages etc..) paid into?

    Forget the apology. You won't get it.

    I had a run-in with my bank over something a few years ago. I told them that I would take an apology or £1000 and they could choose. They chose the £1000.

    You say that you bank did not stop certain DDs. You don'texplain why they should have done this. Please explain

    i cancelled the direct debits and i was assured by some incompetent so and so in india that it had been done when i checked it hadnt therefore payments i had comming out put me about £440 over my overdraftthen they gave me my 20 charges for items under £5 that they had to pay or not pay and charge my for the pleasure of ehach one

    i dont have another account,and i dont think my dad is too keen on me borrowing 1000 a time just incase there are any mishaps and its taking the bank a while to get things sorted

    Hi

    Same here - go a family and the amount they take adds up to a family holidayicon somewhere noce without the stress!!! Seems when i tok that holiday thats when they got the same amount out of me in charges over two months!

    If you hav another account do what i did and shift your salary across asap - at least then you control how much you pay back but the downside is like me you have to fight over your credit rating etc and rcovering th money.

    In light of this mornings (im not used to this computer type correspondence to discuss my private financial affairs openly) type dialogue i fel that i will proceed with the application for refund - lets face it - they are taking the preverbial!

    Start getting used to the computer. It will empower you. If national governments can't keep their populations down because of the Internet then what chance have the banks got in a fairly free and unregulated society?

    what annoys me more is when i check my account one day at the cash machine or online banking they tell me one figure, so i take money out my account and guess what the figure wasnt an accurate figure, so next day all the machines are right and guess what i ve got charges. good [problem] hu!!

    well i posted a letter to Abbeyicon asking for 5 years charges +and interesticon which has been placed on the account as per data request (ta by the way)


    (well done with the fags ,it gets easier 6weeks now)

    while looking for a list of charges on the website i discovered there were not any. how can you be able to sign up and register online if you dont /cant agree to charges.

    You need to have opened an account through the branch system before you can apply for online banking.

    And the charges & T's&C's would be in the application.

    Default branch tells me so it must be ?

    i was charged £55 for the bank paying £5.50paypal payment
    £35 for the other on the same day of £8.20.
    i went into the branch at shanwick place in edinburgh and i was told that because i had £450 refunded in feb i couldnt get any more refunded.
    i told her the charges were well out of order 100%.she did say she was sorry (not the bank)but "THESE CHARGES COME OFF AUTOMATICALLY EVERYTHING GOES THROUGH THE COMPUTER NOW"
    i know she believed exactly what she said but she didnt understand what she was saying.

    Drop her a note - very nice confirming what she said.

    You do understand her predicament now that that everything is fully automated and how difficult it must be to excercise the flexibility that customers were used to once upon a time. Are there any cirumstances in which they might be able to help you.

    See if it attracts a repsonse. If you are lucky it will receive an agreement of the points you have made. At the worst they simply won't deny what you have said - which is almost as good as an admission.

    Keep the letters but let us have a scan of each please.

    Default started new clain (scottish)

    he ho
    i lodged my claim against Abbeyicon today
    and i learned a lot.
    1 it was free (yippee)because i get working tax credit
    2 i could have lodged it in an english court.and procceded for the full 3years at £4500+3years at £4500because abbeys head office is in England OR
    icould have started action in scotland at my local sheriffs office and sued head office but it would not have been very enforcable
    for the full amount
    BUT that would have been no fun and as i have lodged in my local sheriff court for £620+costs+interesticon for 6monthsagainst my local abbey branch where i opened my account it is enforcable.



    therefore it may take a while to get through 5years worth of claims i will be a graduate of the scottish small claims at the end of it.and i will take to the end.

    there are a few other changes claimant=pursuer
    defendant=defender
    i know its small things but the small things matter
    so to any scots wanting to claim-

    Very interesting about jurisdiction. Thanks for the info. Did they really say that you could sue Abbey in England even if the contract was made n Scotland.
    We'be extremely grateful if you would check this out specifically because it will be very helpful to many people if it is correct.
    As you know we have been applying normal juridictional rules and advising people whose contract are made in Scotand that they can only sue in Scotland

    it is aparantly as i had said i can sue using english or scottish law,to sue using scottish law an address in england is not good because all it results in is a piece of paper saying "I WON"like a fake lottery ticket scottish law cant be forced on english law.
