Thread: Go Debt threat of Imprisonment!

I got this very threatening letter today form Go debt. They are considering gaining a county court judgement on me.

they also say If i fail to attend court the court could issue a committal order against me and could lead to imprisonment. I haven a clue what it is as they dont even put what debt it is on the letter. I do know NOT to speak on the phone. I have never answered their letters as they NEVER say what debt it is.

I am currently off sick so no money coming in. This has really spooked me I have enough trouble and don't know what to do now.

~HELP PLEASE!!!!!!!!!!

If you have that in writing take it straight to your Trading Standards!!! What they have done is about as bad as it can get.

Regarding the debt - it is up to them to prove that you owe this money.

Anyone got the standard letter for this?

Send them this amended to suit, and also do as Cashins says and report them for threatening behaviour

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

I am/we are familiar with the Office of Fair Trading debt collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

I/we look forward to your reply.

Might be worth adding a sentence saying that they have made misleading claims in their last letter and to send you a copy of their complaints procedure by return.

Report these morons to the OFT for such a misleading letter. You could only go to Prison if a Judge found you guilty of contempt of Court not on the say so of some imbecile in a DCA with no Legal powers and no brains. In addition to a Formal Complaint to the DCA I would also make a complaint to your MP.

Using the threat of imprisoment to recover a civil debt and IN BLEEDING WRITING aaaaarg! the bloody morons

Do as advised report them to TS the OFT and anyone else you can think of & do it now not some weeks away when they have had time to cook up some excuse for their appalling (& illegal) conduct

If your MP is a member of the Labour Party they will be more than happy to help if they value their job after the next election

If you really feel up to it look at their website under recruitment and phone the directors of this mickey mouse outfit direct and have a nice word with them, but then again why lower yourself to their sub standard level

I also note that you have used the threat of imprisonment for what I would imagine is a civil debt. This behaviour though unsurprising from a company such as yours is in strict breach of OFT guidelines and I understand brings your fitness to hold a licence into question

Therefore please be advised I will be reporting you to the appropriate authorities and should you be foolish enough to continue your appailling conduct I will also report you to the police for criminal harassment

Thanks. letter being printed a I type this then it will be sent recorded post in the morning. don't think I will phone them as i am ex directory and if they get the number my wife will be getting some very bad phone calls and because she has a disability it doesn't help, they even scare me.

For instance We got a debt collection agency once pretending they were from virgin media asking for payment for that months bill, in which we were in dispute with. and they screamed down the phone at her and threatened her.She then phoned me up in tears and you could hear from her voice she was petrified so I phoned up virgin and they waived the bill and made sure they Never used them again.... result!

Just to add to everyone elses posts, you must report these people to all and sundry. This means Trading Stamdards, OFT, fos and your local MP. They should be prosecuted for this.

I suppose it could be true if he did attend the hearing and then smacked the judge or their brief ...

Erm... Nah not really worth it. My Mp George (Gideon) Osbourne is more interested in the posh areas like alderley edge and Wilmslow than where i live. but i will give it a try, but, he didnthelp me with a speeding fine and dont get me started on that!

A occupational hazard when you do and this is total accurate 130.000 miles a year and my car has done 488.000 and is 4 years old! thank god its a company one! or maybe not with the tax i am paying!
