    These are the rules that the fosicon use to judge complaints I hope this is of help to others I found this part of the FSA site hard to find but very useful.

    If I may correct the OP slightly - these ruless appear to be the one's that the FSA expect FIRMS to abide by - not the one's which the fosicon follow.

    The FOS have their own guidelines - available via their own website.

    Do the fosicon not follow these at all then? correct me if I am wrong but i thought the FOS followed FSA guidelines? and if they do not then why do these FIRMS follow FSA guidelines i.e whats the point? If the FOS have completely different guidelines?

    Please allow me to quote from a letter recieved by a well known financial insitution if I may

    ""Should you not be able to provide any such evidence , please accept this letter as our final response. If you decide to refer your complaint to the Financial Ombudsman Service FOS, considering the documents available to me, we would request your claim to be dismissedicon under the FOS rule DISP 3.3.1 (3) R on the grounds that it has not reasonabnle prospect of success.

    Your thoughts please?

    I know it's splitting hairs, but the section you linked to (Section 1) was the FSA complaint handling rules for FSA authorised firms. The fosicon may well check that a firm has followed these rules but these are not the actual rules by which the FOS judge complaints.

    The FOS section is simply two sections below - Section 3 - as the correspondent in your letter correctly refers to.
