    Default Lombard Credit Card PPI

    Hi, I am going to claim the PPIicon from Lombard Credit Card but can someone know what is the unauthorised borrowing rate from 2004-2007 or go for the 8% instead? Please

    Hello Bobbie and welcome

    Do you have all of your statements to know the amounts to claim? If not you need to send a full S.A.R - (Subject access requesticon) you will find it in the ppi sticky. Fill in your details, send recorded delivery and your £10 fee. They have 40days to comply plus 2 days postage. You can check on the royal mail website that they received it and start counting. These statements will also provide you with the interesticon rate or the monthly service interest rate.
    For a copy of your credit agreement, terms and conditionsicon and a statement of the account you must send them a legal request under section 77/78 of the consumer credit act 1974. This costs £1 and they have 12 working days, plus 2 postage to comply, if no show after this they have breached the law, and the account would be in legal dispute, if they fail to produce the document for a further 30days, they commit a criminal offence and should be reported to the oft, fsa and trading standards You will find the template letter in the general debt issues section.

    Brillant! thanks very much for the N1 Template letter, will send it off tomorrow.

    I do have the full SARicon of Lombard statements for overlimit & late fees & also I noticed that I have spend over £700.00 on PPIicon as I am self employed but will wait for the copy of the agreement to return then I will start progress.

    Hiya,
    Can anyone reclaiming mis sold PPIicon even if credit card account was closed? I wrote a letter to Lombard CC for a copy of full agreement including terms & conditions last 2nd June. It arrived today but without the T & C. see below

    Dear xxxxxxx

    Thank you for your letter dated 2nd June 2008, which was received into the Office on 11th June 2008 (I sent it with recorded delivery which it was arrived there on the 5/6/08!!)

    Your request for documents contains some misconceptions about your entitilement to information in a specified form and our obligations to supply that information.

    As you aware this account was closed on xx/xx/2007, and therefore, there is no active agreement between Lombard CC and you with regards to the above account.

    The Consumer Credit Act is for active agreements and therefore there we are under no obligation to provide you with the requested documents as your obligations to us under the agreement has ended.
    I trust the above clarifies matters for you

    Please advise what to do next?

    Bobbie, I believe Lombard CC are under a misconception not yourself. I am given to understand that they have to keep all documents for 5 or 6 yearsicon after the closure of an account for tax purposes and something to do with the Money Laundering laws.

    You will have to do a search for the exact information. HTH

    They have to keep the records for 6 yearsicon and the MUST supply you the information if you request it in accordance with the DPA. They are just being difficult!

    Force them to by sending them a SARicon

    Thanks for your replies, I know they are nightmare, I did received the S.A.R - (Subject access requesticon) & the Credit Agreement but no T & C. I keeping going round circles looking for the T & C online.

    By the way I seem cant find the template letters for claiming back mis-sold PPIicon payments!

    Ok, I wrote to them a numbers of times for the copies of the agreement form & T&C but the T&C was published in 2008 not 2004, I wrote again asking for a copy published in 2004, they wrote back saying:-

    I refer to your letter dated xxxx and advise that all the info you requested was forwarded to you under cover of our special delivery letter dated xxxx. please contact me at above address if in fact you have not received this data. etc

    So anyway I have noticed from the agreement form there is no mention of PPIicon only the one with card proctection plan (CCP) which was ticked for 1 year for £15. If they have no signed acceptance of this cover, do I have the right to claim back? or do i have to write to them again for a copy of the agreement with PPI section??

    Any advice would be really helpful please

    bobbie, if you have been paying PPIicon or any other form of credit card insurance it should show on your statements as a separate entry. They must prove that you requested this cover and if there is no signatureicon or ticked box to say it was requested then that is one reason to claim it back.

    Other reasons are that the cover wasnt explained properly
    Perhaps wasnt suitable.

    If they are refusing to provide you with information you require to make a claim for the mis selling of the insurance and the 40 days timescale has passed. Then I would in the first instance make an OFFICIAL COMPLAINT and head your letter as such to the company laying out your concerns. As a last paragraph in the letter ask them to confirm in writing if this is to be their final response. Once you have their final response you can make an official complaint to the Information COmmissioner who deals with issues regarding non compliance of the Data Protection Act.

    If the statements they have provided you with show the insurance cover, then you can go straight to making up your spreadsheet and send that to them with the covering letter from teh PPI sections. You give them so much time to deal with your request if they dont pay up you then either send everything to the Financial Ombudsman or take them to court .

    The fosicon will be a time consuming route, however if they dont uphold your complaint then it is possible for you to go to court. If you go to court first you cant then complain to the FOS.
