Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I got into some financial trouble a few years ago and following going overdrawn with Barclays they put a lot of pressure on me to take out one of their nasty "Barclays Resolve Loans" Possibly around 1998. I think the loan finished 2001 or 2002. Apart from the interest being horribly high, I vaguely remember seeing some large upfront charge for insurance added to the loan balance at the start. I got the impression this was compulsory as I was a "bad risk". Unfortunately, I have not kept any of the loan papers. Got rid of everything when the loan was paid off. My questions are:
If I write to Barclays are they obliged to give me the details of the loan they sold me including the cost for PPI? Needless to say I do not bank with them any more!
Would I be able to put in a claim as this was before 2005 when the FSA rules changed?
Grateful if anyone got any advice.
cheers!!
You could send them a Subject access request (S.A.R) you must enclose a postal order/cheque for £10.00. They should still have all the relevant paperwork as I believe they are obliged to keep files for 5 years after the
contract has ended. Here are a couple of links you might find useful
When the Liberals and Conservatives were in opposition, they both agreed that banks should pay back high bank charges to customers. Nothing seems to have happened since they came into power as a coalition. PPI Insurance has been sorted. Now they should turn their attention to bank charges and help customers get exorbitant charges refunded.
