My car ran out of petrol on a red route road. It had its mot the day before ( got the fuel filter replaced and think it used all my last fuel) and just as I got two roads from my house it ran out of petrol approaching main crossroads, too obstructive/dangerous to try and push anywhere ,anyway put on hazzard lights and ran 2 mins to garage and got petrol came back and ticket was being written £60. Warden told me to ring and I could get it cancelled, he would make a note I that returned quickly with petrol.Rang the parking office and they wanted receipt of buying the petrol anyway. Ran back to garage from home got receipt posted recorded delivery.Got notice to owner two weeks later wanting £120.Rang and they said they didnt receive letter with petrol receipt .Wrote to ask about procedures I had taken, printed confirmation delivery of petrol receipt and letter and got return letter saying "running out of petrol doesnt permit stopping vehicle"! also "we can confirm we didnt receive letter with petrol receipt" but they had confirmation I sent it from royal mail?. Now they are making me feel lucky I only have to pay them £60. I am really angry they made me run around getting information and telling me I could get it withdrawn. but now enforcing it, and now openly lying I sent no letter when I have proof I Wrote to them they have seen. This is terrible service. what should I do next ? Can I record a new phone call and try to get them to ask me to provide petrol receipt again and push for this as agreement to cancel, I only sent the first letter recorded because they told me they didnt receive another parking fine letter ages ago and still they deny things Im fed up with them. Have you still got the original petrol reciept or can you get another.
As far as Im aware the very few reasons for stopping on a red route are to fill you car with petrol, or water, you were told to do so by a police officer or it was an emergency or the car had mechanical failiure.
You will need to write back to the la and ask for the pocket book notes of the attendant who ticketed, and what are their proceedures for broken down vehicles. (Oh and what policy document have they got in place for discretionary proceedures)
Running out of petrol is not an offence (Unless your in Germany that is) and it is one of the defences to be stopped on a red route.

I have to say I absolutely agree with this German law.
The amount of time I lost when I had a delivery business due to driver's who seem to only run their vehicles on fumes and then break down was staggering.
It should be as vital as having tyres with tread on them.

The ticket is still invalid, the la are trying it on whatever the law in germany states.
ppc buster, I think it was two weeks after ringing to find out what was happening from my origonal letter and petrol proof. While this happened the last thing on my mind was will I get a ticket, I was thinking more like make the car and other traffic safe, garage is down the road it will take two minutes run run run, under these circumstances my la think hey lets make £60 create a lot of mixed advice to motorist lie about letters we didnt get but were recorded then threaten to double fine. I can get another receipt for petrol but they arent rejecting this on that basis, they just dont exept my running out of petrol is reason to throw out the ticket.I knew I needed petrol as soon as the car came out the garage but didnt stop to think it would loose some of the little petrol it had in repair. Anyway the receipt was sent recorded to their office and they lost it. I am more angry about the confusing and truth bending way they are dealing with this. what kind of statement is "although you ran out of petrol this does not permit you to stop on a red route"? Running out of petrol is the same as breaking down, your petrol level indicator could have malfunctioned showing petrol in the tank.
This rule is the same for bus lanesI believe.

What about if a fuel line breaks, leading to the loss of fuel that way?
What about if the fuel gauge is faulty, leading the driver to think he has more fuel than he actually does? (a not uncommon problem with digital/electronic gauges, including in very expensive -supposedly reliable- cars)

1 - If you can actually prove that your speedo was faulty at the time, you could go to court and present it to the judge, and the odds are pretty high that it would be accepted as mitigating circumstances.
2 - The information given is correct, but incomplete: It is an offence to run out of petrol on the autobahn, and you may get fined for that offence. In the same way, it is illegal to stop on the emergency lane on a UK motorway and you could get done for it, but if you actually broke down, odds are pretty good that you won't.
As for the Germans (or any other nation for that matter) not having that law if it didn't work, that comment is of such a profound absurdity that I can only assume that it is only meant as being provocative, as I don't believe that anyone could be that blinkered to believe it.
Tip: Washing your car on the public highway is also illegal in Germany. ;-)

Is it illegal to run out of fuel on the Autobahn?. Technically, there is no law specifically against this, but it is illegal to stop unnecessarily on the Autobahn and this law is also applied to people who run out of fuel as such an occurrence is deemed to be preventable.

Then you are committing a C&U offence - it is illegal for a speedo to under read at any speed. It is not an offence for a petrol gauge to under read; for the simple reason that there is no requirement in law to have a fuel gauge.
And I'm pretty sure the Germans wouldn't have this law if it didn't work.
Two points.
1) The law is not exactly as quoted. It is illegal to stop unnecessarily on an autobahn (possibly to do with the fact that the traffic may quite lawful be moving at 150 mph plus). The Bundespolizei do not accept running out of fuel as a lawful reason to stop.
2) German law operates in exactly the opposite way to ours. Under English Common Law, if something is not forbidden, then it is allowed; under German law, unless something is permitted, it is forbidden.

You don't require proof Sam, but to have it is a bonus;
References to notices or documents being sent ‘by post’ within the Act bring into the
operation the Interpretation Act 1978 by which service is deemed to be effected by properly addressing and posting a letter containing a document. Unless the contrary is proved, service will be deemed to have been effected at the time when the letter would
be delivered in the ordinary course of post.
So you need to write back again, or if you have a telephone recorder phone, and quote the above act to them.
