Can someone clarify this for me. Ive sent 2 letters to reclaim my PPIs the last one being the lba letter. Do i go straight to the moneyclaim option via court? or is there another step? your help and advise would be appreciated. If i have to go through the court has anyone got a template of what i should put in the claim?
1) Is your PPI claim in respect of a loan or credit card?
2) Have you requested a Consumer Credit Agreement or a Data Subject access request? And did you get a suitable reply?
3) What date did you take out the Loan or Credit Card? How much credit?
I sm not sure at which stage you are at BUT Depending on answers to the above questions you could proceed to the fos (best first option but it takes time) Then the Courts faster but cost and you could end up paying costs to the opposition if you lose!!
If you take the FOS route and the complaint is not upheld you can then proceed down the Court route with N1, POC etc etc.
If you take the Court route first then you cannot take the FOS route second as the FOS will not accept claims or complaints that have already been ruled upon in a Court.

hi thanks for the reply. Its for a loan. Yes i have sent them a DSAR and a lba. The amount is £9000 so i will have to put 2 claims in so it can go through the small claims track. The loan was taken out in 2006. I would like to take the court route but what are my chances of winning? and if i did lose what would the costs be!!!!
I have not been down the court route yet. I could not possibly predict how you would fare in Court but there are a lot of really helpful people on this site with a mountain of legal knowledge, plus there is a legal thread area. Again on the costs I am unable to answer but you should be thinking about a most definate win and not losing your case.
If you proceed down the Court route and were not successful then you cannot take your case to the FOS but if you go to the FOS and they do not uphold you complaint you can the go down the Court route (two bites of the Cherry so to speak)
Try and ensure you are not being fobbed off with no response from them press hard to get all the information you asked and paid for.
