Thread: HFC PPI and FOS complaint

I currently have a complaint against HFC with the fos for the miss selling of PPI, the complaint has been with them now for almost 8 months and things are moving VERY slowly. The adjudicator wrote to HFC at the end of last year stating that in their opinion my complaint should be upheld as there is evidence to suggest that the cancellation terms where not properly explained and the policy may not be suitable as I already have a generous sickness package from my employer. HFC have been asked to repay all PPI payments made as well as removing the policy from my account. The total amount would clear the account twice over so it’s not an amount to be sneezed at.

As you would expect, HFC have said that they disagree with the adjudicators opinion and have insisted that the case by put in front of an Ombudsman. As much as it annoys me, I expected HFC to play hardball so I'm not too hacked off. What really boils me onions is that the FOS have said that given the amount of complaints they are dealing with it is unlikely that the my complaint will be allocated to a Ombudsman until September/October at the earliest. This is in my opinion unacceptable.

Do I leave this with the FOS and hope that I receive a favourable decision by the end of the year, or do I consider litigation.

I'm kind of thinking the same way but it seems to be taking SO SO long.

I would also wait. The fos is swamped at the moment as is the ICO. It may take longer to get your result. If at the end of the day the expected result does not come then you have the option of Court proceedings.

On the other hand if you cannot wait and go to Court and the ruling is against you then you cannot go back to the Ombudsman.

It's new territory unlike unlawful bank charges and every case differs but I would suggest FOS first and then Court. Of course the choice is yours.

You have to also remember the HFC have so far had the heaviest fine imposed for misselling The Ombudsman is going to require a pretty sound case in light of the recent fine......FSA fines HFC Bank £1.085 million for PPI failings

Received a letter from the fos this morning and they have upheld my complaint. As this was refered to an Ombudsman there decision is final and HFC are bound by it.

Just done the math and after the loan has been paid HFC owe me £16.33. Once the cheque has cleared I will be treating myself to a case of Guinness

The long and the short of the fos findings is that HFC failed to properly explain that if I were to pay the account off early I would not get the full amount of the front loaded premium back. Also they mentioned in a round about way that the sales person was not acting with in my best interest.

Once everything is settled I will post the letter in full.

I'm in need of a little help - again!!

I FINALLY received the long awaited letter from HFC regarding the refund i am due and I can't for the life of my work out how the hell they have come to the end figure.

Could I ask MOD or helper to check my calculations by PM, sorry guys I'm too embarrassed to publicise how much I borrowed and how much I would end up paying.

Ok guys my calculations where WAY off!

I thought that I was due a refund of approximately £200 after the outstanding balance of my loan had been settled, HOWEVER HFC have offered to settle my loan PLUS refund over £2.5k!!
