      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

Another credit card I have had for years and have been hit with bundles of late charges & overlimit fees.

 

SAR and cheque going out recorded delivery tomorrow - will keep updated with the excuses and rationales as they come up.

 

I am brand new to this, although think I may be able to set a World Record with my charges over the last 6 years - so pleased to finally have the knowledge & confidence to challenge, let alone win !!

Sounds like a nice windfall is probably on its way to you really soon then (It's really nice to see some cash come in that you thaught was gone forever :D). Make sure you folow the procedure set out to minimise their wriggling menouvers to try to worm out of things that IMHO they owe ya! I'm sure the CAG owners will appreciate a donation out of your payout if you possibly can, I know I'm gonna donate when I get paid (eventually 'cos my bank charges have been stayed (put on hold) for over a year!!)

Hi all,

 

RBS have come good so far on the time front (beating Cap 1 so far) and after excitingly totting up my costs it is an unbelievable £824 !!

 

Question : Do I just hack the LBA for bank account charges to send the letter ??

 

Going onto template now to work out the interest calculation - hopefully I can get my head around this part...

What APR do you think I should use ??

 

Staying on my timetable so far - I can do this (thanks for your time)

Thanks so much for all of your help so far, this is just the first credit card of many but want to perfect my process before taking on the others.

Hacked prelim letter today and my charges for the period were 824.

 

Now I applied 8% to this and now the total claim is 996.21, had to use the simple spreadsheet on here.

 

If I applied the credit card rate of about 19% it would make a big difference in the claim. I can see there are loads of schools of thought on this one but unless anyone hugely objects I will send off my prelim letter tomorrow using the 8% - want to keep things simple and am not a greedy man.

 

Still £900 I did not expect & will help loads after donation...

Hi all,

 

After a chase I have received a letter from RBS a couple of days before I am due to submit my LBA Letter & they have offered me the mandatory difference between the £12 and £20.

 

Advice from the site seems to be decline this and plug straight in with the LBA, should I just tear up the cheque ??

 

Have I missed anything else out ??

Have they actually sent you a cheque?

 

You can send the rejection letter, stating you want the full amount.

They have physically sent me a cheque. Reading the very useful link I wa sent (thank you) I will reject the cheque, although bank the cheque as partial settlement.

 

I will make this clear in my return letter and also submit the LBA for the remainder.

 

Will send this tomorrow unless I receive any advice to the contrary.

Real laugh for you all now..

 

RBS sent me exactly the same letter again today with the offer of the difference (the same amount again - £176) I now have 2 cheques for £176 pounds each (bizarrely signed by the same person!)

 

Should I reject offer, whilst banking both cheques as part repayment for full amount or would this be deemed as malevolent ??

 

Please advise ??

After more cheques sent to me and cancelled they have finally, officially told me to bugger off. Which is handy really as my LBA runs out today.

 

I will be putting some time aside tomorrow to complete the necessary court forms and am almost g'teed to need some support so will be posting more tomorrow.

 

Looking forward to a practical day tomorrow to try and put this whole matter to bed - and get refund of all my charges.

Have been reading articles on the site all morning so far (I always somehow get distracted by the success stories !!)

 

I have a copy of the Capital One POC and it all seems straightforward. My 2 questions are...

 

* Can I now claim the 21.9% APR I had on average for the card or do I have stick with the 8% standard ? On this note do I charge interest up to todays date, or the date I submitted the initial claim ?

 

* Struggling to locate exact details for court. Do I submit to my local court naturally & where do I find definative details on costs ??

 

Thanks for any help - hoping to get this filed this week and see what happens..

If you are wanting to claim CI, you need to state this in your prelim and lba letters. The 8% interest you are claiming starts from the day you started your claim.

Do I just send to a Magistrates Court local to me ?

 

If not what type of court does it need to be sent to ?

Your not being thick. You are being careful. No question is ever daft, but a daft mistake could be costly! ALWAYS ask if your not sure. :)

 

It has to be filed at your local County Court. You should be able to find it in the link above i gave you.

Found Romford is my local office so printing up everything now and will send all info and cheque to their address from link.

 

I have this RBS credit card claim and two for Cap one (have seperate thread)

 

Presume I should send them all seperately ?
