Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
After getting my charges back last year I thought that was the end to B'card. The last I knew my debt had been sold to Mercers.
The past few weeks I have been getting demanding letters from Calder Financial - I had no idea who these people were until I just googled them.
I have an arrangement with B'Card to pay £1.00 a month and have been doing so for the past couple of years.
What can I do about these threatening letters that tell me to call within 24 hours else "they will seize my personal belongings" if I do not pay the outstanding balance?
Right then, firstly, i would say if mercers were involved then barclaycard would have merely passed the debt to them for recovery as BC tend to use them for recovery as their own debt collectors
So i would say that at that point they wouldnt have sold the debt to mercers
now onto calders
firstly, their threats are just that empty threats, let me reassure you they cannot touch your possessions as they would need a court order among others and only bailiffs can repossess goods from persons property
if they did try to touch your property then they would be committing various offences
now then, have you received any letter from Calders telling you that they have been assigned the debt? they are required by law to do this if they are now the owners of the debt
have you sent them a request for the credit agreement to substantiate that they are legally entitled to collect upon this debt? or that the debt is even enforceable?
Thanks for your reply.
I have had nothing from Calders, I had to google to see who the hell they were!
I will start with a letter to them asking them for the Credit Agreement first. Any ideas on what I should put in this first letter as I have no idea how to deal with these people. I am quite miffed as I have been paying every month what I agreed to, it makes me wonder where my £1 a month is going?!
Should I ask for a current balance too? I would like to see if the money I have been paying is actual going to my account.
Well, you know better than to call them, of course.
If you sent the CCA request to Calders, leave it at that just now.
If it was sent to BC, just send Calders a copy of the CCA request and tell them if they continue to harass you about the alleged debt, they will be in breach of the OFT Guidelines on debt collection and you will report them to the fos and to Trading Standards.

Hi All
I am new to this site but not barclaycard, mercers, calde rs or whatever the muppets call themselves these days!!
I have had the same problems as moneyhelp, also paying £1.00 month.
Be strong dont take any messing answer all letters/demands immediatly by posting off a income & expenditure letter even if you have alredy sent hundreds.
Have you thought of claiming unfair charges to the account?
I have just received a few hundred pounds back from them, unfortunaltly I wont get any in my pocket as they have claimed that because of all the interest added to the account since I got into difficulty amounted to the present balance !!!
cant prove it cos the muppets refused to send me a statement decaring "they were not a billing agency" anymore to me!!!
(and breathe) sorry for the rant but Moneypot dont let them wear you down, chin up !!!!
any ideas folk what I can do next???
was I supposed to have the money sent directly to myself??
Barclaycard said account not 'really' defaulted just in debit balance????
many thank
Muppy......
