i contacted Littlewoods visa, a subsidary of Barclays, saying i believed PPI was misold to me, because i was self employed and did not pay Ni contributions, so did not fulfill the requirements for ppi. This i had learnt from Capital One who refunded all ppi back to me.
I was told that their policy covers all self employed who work 16 hours or more.I cannot verify this, as do not have a copy of the actual ppi policy. I am sure i did not request it, and asked a year ago for them to send me copy of the actual credit agreement, showing where i signed for it. Nothing from them. They have now cancelled ppi on my request. Not sure what to do next, any advice will be greatly appreciated.Thanks.
I think you need to do a SAR request where they have to provide all the relevent documentation, state clearly what you require from them and not just a Breakdown of charges.
Did they state in writing that you were covered for this or just over the telephone?

This is a bit of a hornets nest, that needs a big poke with a stick:grin:
When you state you asked them over a year ago,for your ca, did you send them a legal request under section 77/78 of the consumer credit act 1974. If you didn't send one immediately. If you did they are in criminal default of the cca
As previously suggested, send a full SAR you will find one in the ppi stickies section on the ppi forum.
They think they are probably in the clear as it is over a year, but you must see this process through and get your payments refunded.

Hi thank you kindly for the replies. I did a SARS request over a year ago, when i was claiming for my charges, which i had refunded after filing in court. But at the time, i didnt know that PPI doesnt cover you if your self employed and not paying NI contributions. I was told this by another company, who refunded all my ppi charges. At first the lady i spoke to said she didnt know so had to ask her superior, who said their ppi policy did cover me or anyone who worked 16 hours or more. I told her i would be looking into this, and requested they cancel the ppi as its no good to me. So i think i will write to them requesting them to refund the ppi, and asking them to provide me with a copy of the terms and conditions, and the original credit agreement, stating that they were asked to do this, in my original sars request, over a year ago, and take it from there.

Sent them a legal request for your credit agreement under the cca 1974.
You will find the template letter in this link, it is letter N and costs £1, send everything recorded delivery and retain receipt for your file. You can check on the royal mail website when they received it. There are statutory timescales, 12working days(then breach), then a following 30days, criminal offence.

Hi Hellhasnofury, thanks for that. I sent another SARS request with £10. they have sent statements but no credit agreement or terms and conditions for PPI, which i asked for. Am waiting to see what happens this week.
Updating this thread, Barclays sent a credit agrrement showing my name signed in the PPI box, and a computer generated cross, in between 2 brackets, in the corresponding box. If i remember rightly, you usually have to tick an empty box to agree! I am not sure if i signed or not now. As it turns out going through my notes and papers i contacted them in April 07 querying the ppi then and requesting it was cancelled, i have the ladies name as i always keep notes of my calls.But they still kept charging me for ppi until they cancelled it in may 2008.Having recieved all paperwork through my SARS request my call is logged in one of their printouts.They dispute that i cancelled it last year and said i agreed to it. I was never sent terms and conditions and no one explained to me that it was unlickely they would pay out on a self employed persons claim. Do i have a valid claim for ppi, they say i dont. Any advice will be greatly appreciated.
being reading your thread and im the same as u.I have littlewood visa,self employed and with.PPI.I sent SAR last year for charges and got the full £112 back.with the ppi sent a letter asking for refund.Just got reply saying u put cross on box and had full 30 days to cancel so do one.This is r Full and final reply. love bug
Hi, did they send you a copy of the Credit agreement showing you had ticked the PPI box? They sent me one, but the box has a computerised cross in it, usually you have to tick it! Anyway i have filed out a claim and will send it to the court. Hopefully someone will drop by and give some advise. Good luck with your claim.
