Hi thereMy employer is asking me to pay back £1100 in overpayment from 2 years ago. Can they do this and do I have to repay it?It was an error on their part, and I knew nothing about it until they faced me with it last week.Apparently, they have overpaid me on salary and underpaid me on SSP. it only came to light when I checked on my sick leave, due to their failure to make reasonable adjustments and after an accident at work because of this, I wanted to make sure I was not going to get into a nil pay situation, and hey presto, this is what they come up with!What is my legal standing on this?
Check your employment contract or speak with your union rep, if in the union, Accidents at work, should result in full company pay, not ssp sick pay, if there are just paying normal sick benefits, when/should you claim for the accident, remember to claim for loss of earnings, its in the companys best intrests, to continue paying full pay while you are off due to the accident, as it will be deducted from any compansation when the claim is settled... Any money over-paid, can be repaid if required, by offering a weekly or monthly payment deduction, but for now, i would politely speak with your HR or payroll dept, take a wittness if you are not in a union, and ask that the company as a gesture of goodwill continue to pay wages as per the terms and conditions of employment/contract. Untill your claim is settled, i'm hoping you are in a union, as you will need some support and guidance in making such claims with companys, failing such, have you any legal plus services within any insurance, you hold, read the small print, there services might assist in such instances, put in writing, that you do-not athourise the company to make any deductions from your salary.
Basically, they have taken it as normal sick leave, 2 weeks of which I had to have as annual leave as well, so what can I do about this?They were told to complete a risk assessment 12 months ago, this was never done, after a further OT referral, a risk assessment was recommended, this again was never done. I then fell down the stairs at work, had to have the time off, and a risk assessment was finally carried out 2 months after the accident at my insistance.Union? waste of time, I reported the accident to them and they have never followed it up with me, I am seriously contemplating cancelling my subscription!!
