Default Car Dealer said it was '94.. it turned out to be '93!

    Hello to Everyone,
First of all, a very big thankyou for making this site/help available to those who don't know who to turn to next. What a mine of information.
This is my first post, being an absolute newbie & i'm here because like most users, i need help & advice.

I have recently purchased a car from a locally well-known Japanese Import Dealer. He told me the car was a 1994 on a 'M' plate, i was reasonabley happy with the price & agreed to go back the next day to leave a deposit, which i did. The dealer told me it would take approximately 2 weeks to get the car serviced, valetted, registered & some minor touch-up, repairs etc.
He also then informed me, somewhat apologetically, that it was actually a '94, but on an 'L' plate.
This dissapointed me a little, so we agreed a £99 discount off the £300 cost of fitting an insurance approved alarm/immobiliser.

On the agreed collection date i duly paid the balance, & took my car away. When i got home, i looked at the paperwork & noticed the dealer had not given me the green tear-off portion of the V5.
I then went back to the Dealer and asked for the slip. He then said he didn't know he was required to give me this 'new owner' portion of the V5, & he told me, quote.."i'm sorry, but i've given you all you need".

Now, today the new V5 document arrived at my door (3 weeks from date of sale) & upon checking the vehicle details, i find the car is in fact a 1993 model, not 1994 as the Dealer described.

I am not sure if i have any redress with the Dealer, i do like the car but i feel a little like i have been misled.

So i would appreciate any advice from this super site. Thankyou.
    Malcolm.

What Car salesman does not know the year of a car he is selling ? It all sounds bit mysterious.Presumably you was given a price on the understanding that the vehicle was a 94 on an M plate. It dont take an expert to know that an L plate is going to sell for less than an M ..(of course based on mileage and condition but this was not relevant in your case)....
The only way that you would know for sure was by having the V5 to see.
So I think given what you are saying, you have been sold the vehicle and agreed to the sale on the information given at point of sale.
Did you not become aware of this when you arranged the insurance? that would flag up straight away.....
If its a reputable garage then they should listen to your complaint as its a valid one.Unless the Salesman admits that he gave you wrong information..or that the bill of sale/or invoice states the vehicle as a 94 model...its your word against his that you would not have bought the vehicle for the price offered, had you known the true facts.
That said I am sure that you will be covered under some form of remit and that a call to trading standards for their opinion would not cost anything.
Before they would assist you they would want to see that you had contacted the dealer to invite a response from them.
Dont leave it do it ASAP.
If they are a reputable dealer then there should be no problems and they may offer a quick resolution. If you have no joy then let them know you will be seeking the help of trading standards.

the car is an import, it can be a nightmare to get build dates and other details for these, also bear in mind the vehicle is 14-15 years old!! will it make that much difference anyway?

    Thanks for you veiws Martin,
I've contacted the Dealer this morning & told me that he was genuinely unaware it was in fact a '93 model.
However, he seamed quite reasonable over the phone & as the car has to go back due to some small problems to be put right under the warranty, he suggested we have a talk, to try & come to an agreement.

I will of course let you all know the outcome. Thanks again.
    Malc.

    Lancer,
Yes, the car is an import.... as were my previous two!
The V5 states the exact date of manufacture, as did my other imports (albeit in Japanese).
Your comment re. does it matter, it's 14 yrs old anyway. Well yes, it does matter.
I don't have that much money & it meant a lot to me thinking i was moving up to a little younger car. My trade-in was a '93 model & i came away with a '93 model.
I was led to believe i was buying a '94! So, yes, it does matter...but thanks for your input anyway.
    Malc.
P.S. 14 years is nothing to worry about with Japanese imports....the condition is usually on par with a 3 yr old British car, due to absence of road salt & climate, also most have very low mileage to boot.
The only downside is Insurers usually penalise these Imports (higher premiums).
