    Default nto wording

Quick question on wording of nto's

If it uses the language 'you must pay WITHIN 28 days of service of this notice to owner'

    will this invalidate the nto

    many thanx to all.

No, because the owner is liable and an NtO is addressed to the owner.

sorry to be a pain, I was wondering about the use of the word 'within'

in the lukha v ayslebury vale (i think) and barnet v adjudicator.

it states that the charge certificate uses the word 'within' effectively extending the length of time to pay by one day, so thus nulifies the charge as being non compliant.

Would this apply to nto's or other notices where this occurs.

    many thanx

Sorry. I thought that you were trying to bring the "you must pay" defence across from pcnicon to NtO; which doesn't work.

No idea about the "within". I'm sure others will be along.

many thanx anyway, just had it confirmed. It is invalid.
