Debit Card transaction card holder not present, lost £6350
Hi all,
I had a transaction on my account in Mar 07 for over £6000 from a web marketing company.
They spoke to one of my colleagues and had agreed a 1 years contract for online advertising.
My debit card was used for the 1st months deposit, or which I did not sign or authorise.
Since then I have been in contact with the Lloyds TSB debit card concerns team and they have been dealing with the issue. The company involved have sent loads of nonsense and so called proof of the services that they have provided. I have written into Lloyds TSB stating that I did not authorise the payment, nor have I received the goods they are saying they have provided.
I was anticipating that with Lloyds TSB and Visa debit card schemes in place, a simple chargeback would be in answer. However Lloyds have written to me saying there is no route to obtain a refund though the processing bank within the membership rules of Visa International In the absence of any written evidence to establish a claim against the retailer, there is little we can do to support your claim. My claim was that I did not authorise the payment nor receive any of the goods. Then they say:
I feel that is is important to confirm at this stage that the nature of the Visa system is such that payment is guaranteed to the supplier of the goods or services once you have provided then with your details of account. We are unable to stop this charge, therefore, please remember that a payment made by a debit card is similar to one made by cash and its is for this reason that card are normally accepted thought-out the world.
Please note that the debit card is not covered under the Consumers credit act 1974, therefore we suggest you seek Legal advice on the way forward.
Being a merchant myself, I have lost all of my chargeback's where I have debited a card with customer not present.
However on earth have this company managed to keep my £6350 of which I did not even sign, have an agreement, or an affidavit in place to authorise the payment and not successfully get my charge back?
The transaction have on the 27th March 2007 therefore I am scared I have left it too late?
Any advice would be great as Lloyds Are really not being helpful....
Re: Debit Card transaction card holder not present, lost £6350
As Lloyds have given you a response to your complaint which is clearly not satisfactory I would now raise a complaint with the fosFinancial Ombudsman Service
