    Default Maternity leave

    Hi i'm on maternityicon leave at mo and getting maternity allowance. My HR ( dont know what there doing) have tried telling me that they dont have to give me my job back as it was when i return because they are not paying my maternity pay. Is she right or talking out of her a*** again. I thought anyone on maternity allowance was entitled to same rights as smp. Can anyone clarify before i shout at her.

    Absolute rubbish. Irrespective of whether you are on SMP or Maternity Allowance, you are protected under the Sex Discrimination Act and could take the case to a Tribunal for unfair dismissal on the grounds of sex discrimination.

    You also have certain rights where redundancyicon is concerned (if they try to claim that your position is redundant).

    It sounds like your HR officer, is a bit of a pr*tt, however I would read the information Maternity leave on the above site.
    I know there are a couple of HR Experts on the forum I am sure they will advise you.

    Thanks for your replys, the site you suggested Andy was great thanks it will come in handy for a few people. I'm going to wait till she actually contacts me instead of going through my husband. Both work for same company hes just higher up the food chain so hr woman seems to think she has to speak to him instead of me. I didnt have any intention of going back but now shes said this i might just to see what they do.
