    Default OPC Parking Fine

    I have received a response from OPC denying my appeal that a parking fineicon was invalid as I was outside their parking area. They have now said that I was on an access road which they own and not a public road. I did not see the sign (even though it is quite big now I have gone back to look at it), but have never realised that a private company can actually own a road so never thought to look for it.

    Should I accept this as my fault, or should I still appeal under the gorunds that I was not in contract with them due to me not seeing the sign?

    you appealed to a PPC ? mistake. stop contact with them. IF it is a private road the signs are meaningless. google for all these words

    and check the status of the road - if OPC own that road it will be a miracle, got a map reference/google earth location ?

    You should either ignore or respond using the template letters from this site.

    DO NOT PAY! THESE PRIVATE PARKING TICKETS ARE JUST UNENFORCEABLE UNSOLICITED INVOICES.

    Don't bother "appealling" - this is just a shamolic process whereby the parking company decides for itself whether it should get paid or not hummmm..... you can imagine what the answer is.......

    I used one of the template letters, saying that I was not causing them damages (loss of income) as I was not in an unpaid for bay. But they are saying I am in breach of the contract that I entered into with them by driving down their access road. I can see the road on google maps (sattelite view) but it does not have a name and google show it before the housing complex has been built there, but it is a small road, which i guess could be an access road owned by them?

    indeed. and check with council as to who actually owns the road. It is dollars to doughnuts that OPC do not own it. then chase the owner of the road.
    this sounds like another highview situation - needs to be stopped. get onto local press as well..

    I just called the council and they said it isn't an adopted (owned by the council) road.

    I just re-read the guide, so I see my last defense is that I did not see the sign and/or that £100 is too high to be considered a fair amount for parking on their land?

    Please help!
    I have today received court papers from Northampton CC. Claimant OPC parking.
    Story: Parked in OPC car park. 2 tickets issued over 2 days. Paid them (stupidly i know, but i hadnt found all this info then!)
    Several months later a request for payment for a 3rd fine arrived in post. There was never a 3rd ticket on the car.
    Usual letters etc ensued from OPC and WSP.

    Anyone have any experience of how to write a defence?

    Really sorry if i have hijacked anybody's thread. Im just really upset by this, but want to fight them. I just dont know how to and im not sure where to start.

    sorry Al27, just pm'd you and forgot to say the following. Yes, i do want to claim for the paid tickets (how stupid was i ?!) but at the moment i think i should win the court case they have against me to set a precedent, then put in a small claims court case against them to claim money back, with interesticon etc.

    Im in court next month for my parking ticketicon. im claiming i was not driving i was wondering if anyone has any tips as i have seen the paper work they are sending the court and there is no pictures of whom was driving.

    I would just make sure you get the best defence of the people of here.

    Make sure you word everything well and prepare it well.

    yeah its going to wolverhampton court on the 13th of aug. I dont see what they can say to me as they have no idea who the driver was. I replied to all there letters saying i would assist them if they would send a photo but every time they said no.

    from what i have read its up to them to prove i was the driver.

    OPC lose as we know But if you lie in your defence then you will lose. People have always beaten them fair and square. As you will have already lodged you defence your course is set. Don't lose the record for us or we will have to start again.
